EXTRAORDINARY PLENARY - HEALTH

EXTRAORDINARY PLENARY

Bringing out the broom. The Congress of Deputies will hold on Thursday the 23rd the famous 'Broom Plenary' in which the matters that have remained pending during the session period are included before the curtain falls for the summer break. The agenda is not closed and will not be official until Tuesday, but DEMÓCRATA advances its main points.

Another opportunity for the path. The path of budgetary stability, which was rejected last week, returns to the Plenary for its second chance. It is not expected to succeed, as the result will be the same; however, the law allows the Government to move forward with the process and bring the Budget project to the Chamber starting in September.

Anti-crisis shield. The groups will vote on the validation of the royal decree-law of anti-crisis measures to address the consequences of the conflict in the Middle East. It includes the extension of tax relief on fuels for households and the gradual withdrawal of the so-called generation tax, the Tax on the value of electricity production.

Early retirement. The Plenary examines another royal decree-law, in this case, the partial early retirement of the labor personnel of the Public Administrations and the insularity supplement in the Balearic Islands.

Bridge to the RETA. The reform to facilitate alternative mutualists a bridge to Social Security is close to becoming a reality. After the approval of the bill in the Senate with modifications, Congress will vote on them, leaving the norm ready for publication in the BOE. However, the definition of many of its aspects remains subject to subsequent regulatory development.

From the Senate, with love. The Plenary of Congress will address the amendments introduced by the Senate to two other bills: the reform of the neonatal screening program of the SNS and the transfer of the competencies of the AP-9 to Galicia.

PP and Vox, against the debt forgiveness. The hemicycle will debate total amendments registered by PP and Vox against the bill of exceptional measures for financial sustainability for the autonomous communities of common regime, whose core is the forgiveness of the autonomous debt. Both groups request the return of the text, arguing that it breaks the principle of financial responsibility, generates inequality between regions, and is the result of a bilateral pact to favor Catalonia.

Being a group will be easier. The report prepared by the Rules Commission to lower the requirements for forming a parliamentary group, via reform of the Regulations, reaches the Plenary.

HEALTH

Lists to continue. According to what DEMÓCRATA has learned, two important bills promoted by Health have already passed through the CGSEYS and are ready for the Council of Ministers, so their approval will be imminent, possibly this Tuesday: the Draft Law on Medicines and the anti-tobacco reform.

What is the parliamentary status of the reform of the Organic Law of the Judiciary proposed by the PP and what are its next steps for approval?

The expression “reform of the Organic Law of the Judiciary (LOPJ) proposed by the PP” today practically refers to the package of initiatives by the Popular Party to change the election system of the General Council of the Judiciary (CGPJ). As of September 7, 2026, these initiatives are in very early stages or are blocked, and none of them is yet close to becoming law.

1. What PP initiatives exist regarding the LOPJ

  • Organic Law Proposal on the election of CGPJ members registered by the PP in Congress in 2025, so that the 12 judicial members are directly elected by judges and magistrates and only the 8 jurists continue to be appointed by the Cortes. The PP itself describes it in its note “Let the judges choose the judges” (link).
  • Organic Law Proposal processed in the Senate, with the same objective that the 12 judicial members of the CGPJ be elected by direct suffrage from the judicial career. The Senate has already debated it in Plenary and has taken it into consideration, with support from PP, Vox, and UPN and abstention from PNV (Demócrata).
  • Additionally, on September 2, 2026, Demócrata details that the PP has registered a new organic law proposal in Congress to modify the CGPJ appointment system and that the first debate and vote is scheduled for the Plenary on September 10, 2026 (link).

2. Current parliamentary status

Combining institutional sources and press information, it can be summarized as follows:

  • Congress of Deputies
    • The organic law proposal presented by the PP for judges to elect judges is registered, but the institutional database shows that similar PP initiatives to reform the LOPJ have even been rejected for processing by the Board in this legislature (case of initiative with identifier 120/000044, not admitted on 03/11/2026).
    • According to Demócrata, the new proposal on the CGPJ appears in the draft agenda for the Plenary on September 10, 2026, so as of September 7, its status is pending consideration by the Plenary; it has not yet passed that first vote nor entered the amendment phase.
  • Senate
    • The PP organic law proposal for the 12 judicial members of the CGPJ to be directly elected by the judicial career has already been taken into consideration by the Senate Plenary. The text has received a first political “endorsement,” but has not completed processing: the amendment, committee report, and final Plenary vote phases are still pending.
    • After this process in the Senate, any law proposal originating in the Senate must be sent to the Congress for a full second reading.

3. Next necessary steps until possible approval

Focusing on the reform promoted by the PP to change the CGPJ election system, the parliamentary path it would have to follow to become an organic law is as follows:

  • In Congress
    • Consideration in the Plenary (scheduled for September 10, 2026, according to the draft agenda). If rejected, the initiative fails; if approved, it enters ordinary processing.
    • Opening of the amendment period and referral to the Justice Committee.
    • Work of the committee, preparation of a report, and subsequent committee opinion.
    • Debate and vote in Plenary, with a final overall vote that, as it is an organic law, requires an absolute majority.
  • In the Senate
    • If the initiative originates in the Senate (like the one already taken into consideration), it must go through amendments, committee, report, and Plenary there; once approved, it will be sent to Congress.
    • If it comes from Congress, the Senate may approve it without changes, introduce amendments, or approve a veto. In case of amendments or veto, the text returns to Congress, which has the final say.
  • Once approved by both Chambers, the reform would be sent to the King for sanction and promulgation and published in the Official State Gazette (BOE), entering into force on the date set by the law itself.

4. Differentiating it from the reform already approved in 2024

It is important not to confuse these PP initiatives with Organic Law 3/2024, of August 2, reforming the LOPJ and the Statute of the Public Prosecutor's Office, agreed upon by PSOE and PP and already fully in force (BOE of 8/5/2024). That law introduced requirements and incompatibilities for CGPJ members and judicial officials and tasked the Council itself with preparing a proposal on the future election system of its members, but it did not implement the model of “twelve members directly elected by judges” that the PP now advocates.

In summary: the specific LOPJ reform promoted by the PP for judges to elect the 12 judicial members of the CGPJ is in an initial processing phase (consideration pending or just passed, depending on the Chamber), and still has all the amendment, committee, Congress and Senate plenary phases and the final absolute majority ahead before it could be approved.

What are the competencies and political trajectory of Yolanda Díaz, Second Vice President and Minister of Labor and Social Economy?

Yolanda Díaz Pérez (Ferrol, 1971) is a labor lawyer and one of the main figures of recent Spanish left-wing politics. She currently serves as Second Vice President of the Government and Minister of Labor and Social Economy, responsibilities she combines with her role as leader of the political space Sumar, although she resigned as party leader in 2024 after poor results in the European elections. In July 2026, the Government also promoted her candidacy to lead the International Labour Organization (ILO).

Competencies as Second Vice President and Minister

From the Second Vice Presidency, she plays a role of political and economic coordination within the Executive, especially regarding the labor market, labor rights, and social economy policies. Her position involves participating in defining the Council of Ministers' agenda, in internal negotiation of major regulatory packages, and in representing the Government both nationally and internationally, for example at the G20 or European Union forums.

As Minister of Labor and Social Economy, according to ministerial restructuring regulations and administrative practice recorded in the BOE, her department is the body responsible for the proposal and execution of Government policy on employment, social economy, and corporate social responsibility. Among her material functions are:

  • The design of employment policy and labor relations, as well as drafting the corresponding labor regulations.
  • The regulation and supervision of the Social Economy (cooperatives, labor societies, insertion companies, etc.), including promoting strategic projects such as the PERTE of Social Economy and Care.
  • Promoting social dialogue initiatives with unions and employers to agree on labor market reforms.
  • Leading the policy on labor inspection and strengthening the fight against precariousness, including specific campaigns, for example, in domestic employment or digital platforms.
  • Participation in European and international employment forums, where she has promoted initiatives on workplace democracy and a Global Charter of Rights to advance labor standards.

Under her mandate, the Ministry has been publicly identified with several lines of action: successive increases of the minimum interprofessional salary, approval of the so-called “Rider law”, a labor reform in 2022 aimed at reducing temporary contracts, expanding protection for domestic workers, promoting reduction of working hours, and defending a productive model linked to social economy and green employment.

Political trajectory

Coming from a family linked to the Galician trade union movement, Díaz trained and worked as a labor lawyer, which shaped her technical profile and her network of alliances with class unionism. From there, she made the leap to institutional politics in the Galician left-wing space, before projecting herself into national politics.

On the national stage, she consolidated in the left-wing environment to the left of the PSOE, first in confluence candidacies and later in the Unidas Podemos space. With the formation of the coalition Government with the PSOE in 2020, she assumed the Labor Portfolio, becoming one of the most visible figures of the Executive for her ability to close social dialogue agreements and her discourse focused on “working people.”

In 2021, she was appointed Second Vice President of the Government, strengthening her political weight within the Cabinet. From there, she articulated the Sumar project, with which she tried to regroup parties and sensitivities to the left of the PSOE. As leader of Sumar and a reference of the Government’s minority partner, she led negotiations on the main labor and social packages of the legislature.

According to her parliamentary profile, she is part of the Plurinational Sumar Parliamentary Group in Congress and is a member of key committees, such as Labor, Social Economy, Inclusion, Social Security, and Migrations. This presence allows her to regularly report in parliamentary sessions on her ministry’s policies and debate ongoing reforms with other groups.

In 2024, after Sumar’s poor results in the European elections, she announced her resignation as party leader, although she retained the Second Vice Presidency and the Ministry of Labor and Social Economy. The press and the Government itself have highlighted her profile as a negotiator, her emphasis on social dialogue, and her international projection in labor rights, culminating with the Executive’s decision to propose her in 2026 for the Director General of the ILO.

What requirements must be met to access professional diesel fuel rebates for transporters in Spain?

The so-called professional diesel is the general-use diesel used as fuel in the engines of certain transport vehicles and entitles to a partial refund of the Hydrocarbons Tax, regulated in article 52 bis of Law 38/1992, on Special Taxes and developed by Order HFP/941/2022, of October 3.

1. Who can be a beneficiary

The refund is granted to the holders of the vehicles referred to in article 52 bis.2 of Law 38/1992 (natural or legal persons) who:

  • Are holders of vehicles considered “authorized vehicles” for the purposes of the regulation (professional transport of goods and passengers as defined in that provision).
  • Use general-use diesel as fuel in the engine of those vehicles.
  • Carry out a transport economic activity (company, self-employed, etc.), registered in the corresponding activity in the tax census.

Order HFP/941/2022 defines the holder of the authorized vehicle as the person or entity listed as such in transport records or in traffic, road safety, and vehicle circulation registries, as appropriate.

2. Prior registration in the beneficiary census

An essential condition is prior registration in the Census of beneficiaries of refunds for professional diesel and of vehicles under their ownership of the Tax Agency:

  • The application must be submitted compulsorily electronically through the AEAT Electronic Headquarters.
  • It must include, among others, the following applicant data:
    • NIF, name or company name, and tax address.
    • Description of economic activity and start date.
    • Bank account (IBAN and, if applicable, SWIFT) for refund payments.
    • Email address and, if applicable, fiscal representative data.
  • For each vehicle for which the refund is requested, the following is required:
    • License plate and country of registration in the EU.
    • Start date of the vehicle’s activity.
    • Maximum authorized weight.
    • Number of the Transport Card (Spanish goods vehicles when applicable).
    • Number of the Company Authorization (Spanish passenger vehicles when applicable).
    • For taxis without state authorization, municipal license number and municipality.
    • For vehicles registered in other Member States, the number of the administrative transport authorization and the issuing body.

Any modification of these data must be communicated to the AEAT within a 10-day period, and cessation of activity or withdrawal of authorizations entails removal from the census.

3. Requirements on consumption and limits

The basis of the refund is the volume of diesel acquired and used as fuel in authorized vehicles, expressed in thousands of liters. Law 38/1992 establishes:

  • A maximum consumption per vehicle for refund purposes (maximum refund amount), set out in article 52 bis.6.c).
  • The quotas subject to refund are calculated by applying the refund rate set in the same article.

Additionally, recent documentation from the Ministry of Transport mentions a limit of 50,000 liters applying to the professional diesel refund, a limit the sector has requested to be removed, confirming the existence of quantitative caps on refundable volume.

4. Fuel payment method and professional diesel cards

For supplies at service stations (retail sales facilities), the regulation requires that:

  • Payment for diesel is made using professional diesel cards authorized by the managing office.
  • The card must be issued in the name of the holder of the authorized vehicle and clearly indicate:
    • Name or company name of the holder.
    • License plate of the authorized vehicle.
  • Only issuing entities that have previously registered their cards in the Register of professional diesel cards can issue valid payment means for this system.
  • The use of the card by the beneficiary is considered, for tax purposes, as the request for the refund.

Issuing entities must send detailed information weekly to the AEAT on supplies made with these cards, allowing monthly calculation of the refund to be credited to the beneficiary’s account.

5. Own consumption facilities

If the transporter has own consumption facilities (own tanks where the fleet refuels), these must be registered in the Census of own consumption facilities of professional diesel, and the holder must meet additional requirements:

  • Registration in the Census of Entrepreneurs, Professionals, and Withholders under a heading consistent with the activity.
  • Being up to date with tax obligations.
  • Having the authorizations required by Law 34/1998 on the hydrocarbon sector.

In summary, accessing professional diesel rebates requires being the holder of transport vehicles that fit the authorized vehicles of article 52 bis, being previously registered in the beneficiary and vehicle census, respecting the legally established consumption limits, and strictly complying with the formal requirements of payment through specific cards or, where applicable, registration of own consumption facilities.
