The agrarian organization UPA CyL has formally requested the Government Delegation to hold a meeting to demand immediate action following the recent ruling of the Superior Court of Justice of Castilla y León (TSJCyL), which determines that administrative irregularities in diesel deposits cannot be a reason to deny the refund of the Hydrocarbons Tax (IEH).

According to the organization in a statement, in Castilla y León there are "thousands of cases" in which the Tax Agency has rejected the reimbursement of the IEH to farmers and ranchers, citing rulings related to the authorization, registration, location, or capacity of the fuel deposits.

UPA CyL argues that these issues should not result in the loss of the right to a refund as long as the effective agricultural use of the diesel is proven.

Therefore, the organization demands that, in light of the TSJCyL ruling, the refund be paid "immediately" to all agricultural professionals in the community who have been denied the amount in recent years.

At the same time, the entity considers the Tax Agency's actions "inappropriate" for dismissing the requests for not demonstrating the existence of legalized deposits before the Board.

Finally, UPA CyL has announced that it will demand from the Government delegate, Nicanor Sen, that the ruling "sets a precedent and reverses the damage caused," understanding the loss of the right as "unjustified" when it has been proven that the diesel was purchased and used in agricultural or livestock activity.
