The Prosecutor's Office is seeking prison sentences of 20 months for each of the two defendants for a robbery with intimidation against a man who turned out to be the dean judge of Orense, Leonardo Álvarez, whom they approached using a compressed air pistol.
The preliminary hearing has been scheduled for June 18 in Courtroom 2 of the Criminal Section of the Court of First Instance of Orense, where the accusation formulated against both defendants will be analyzed.
According to the fiscal's written statement, the events took place on January 29, 2024, around 3:20 PM. At that time, the two defendants had previously agreed to select a passerby who was carrying valuables to seize them and immediately leave the scene after obtaining the loot.
Account of the events
With this plan, one of the defendants called the other—as agreed—when he located the dean judge—who was accompanied by a second victim—while they were walking along Rúa dos Fornos, in Orense. Immediately afterward, he positioned himself behind, on the left side of Leonardo Álvarez, and held a compressed air pistol to him while demanding that he hand over his watch under the threat of killing him.
Given the magistrate's refusal to comply with the demand, the defendant brought the weapon to the judge's forehead, repeating the same threat without achieving his objective, and then pointed the gun at the head of the second victim and warned her that he would kill her.
Finally, the defendant lunged at Leonardo Álvarez with the intention of snatching the watch, resulting in a struggle between the two until the assailant decided to flee the scene "without achieving his purpose," getting on the motorcycle on which the second defendant was waiting for him and "making his escape."
As a result of the assault, the dean judge suffered scratches and abrasions on his chest, abdomen, and hand, in addition to the tearing of the t-shirt he was wearing, valued at 47.20 euros.
Request for sentences
In view of these events, the Public Prosecutor's Office charges the two defendants with a crime of robbery with intimidation and use of a dangerous instrument in an attempted degree, as well as a minor offense of assault.
Therefore, for each of them, the imposition of a penalty of one year and eight months in prison for the crime of robbery is of interest, along with a fine of two months with a daily quota of 5 euros for the crime of assault. In addition, it requests that both jointly and severally compensate 100 euros for damages.
