The Provincial Court of Madrid has issued a search and arrest warrant against one of the two drivers prosecuted for the fatal 'race' on the M-30 on July 25, 2021, an accident that caused a doctor who was returning from his shift at the Fundación Jiménez Díaz Hospital to lose his sight.
The statements of the accused were to be held this Wednesday, but one of them has not attended the hearing, something that has caught even his own lawyer by surprise. Both are charged with a crime of homicide and another of reckless driving, for which the Prosecutor's Office requests fifteen years in prison.
Given his non-appearance, the court has decided to suspend the session for two hours to allow the Civil Guard to try to locate him in Loeches. Despite the efforts made, the agents have not managed to find him neither at his home nor in the vicinity of this municipality in the Community of Madrid.
After unsuccessfully reporting these proceedings, the president of Section 30 has informed the parties and the jury that she would issue an order for their search and arrest to proceed.
If the accused remains with whereabouts unknown, the popular jury in charge of assessing the facts will have to be dissolved, as established by the Criminal Procedure Law. Next Monday has been set to make a definitive decision on this matter.
Despite everything, the magistrate has maintained the session scheduled for tomorrow in case the defendant finally appears. In his intervention, the representative of the Public Prosecutor's Office has opposed the trial continuing without the presence of one of the accused.
Among the key evidentiary elements of the procedure are the recordings from the M-30 security cameras, which reflect speeds of up to 176 km/h in a section limited to 70 km/h.
Nevertheless, the defenses question the reliability of these figures, arguing that the speed estimates have been made based on images captured by the M-30 cameras and not by means of homologated radars.
