The Prosecutor's Office of the Principality of Asturias has requested a sentence of 1 year and 9 months in prison and 5 years of driving license withdrawal for a man accused of running over three minors in Oviedo after invading the sidewalk while driving at excessive speed, according to the Public Ministry.

The Public Prosecutor's Office has filed its brief of provisional conclusions before the Instruction Section of the Court of Instance of Oviedo, square number 1. According to the Prosecutor's account, at approximately 08:12 on January 24, 2025, the accused was driving on Hermanos Pidal street in Oviedo at a speed clearly exceeding the limit and without adapting his driving to the road conditions.

Upon reaching the intersection with Padre Vinjoy street, and despite the traffic light having turned amber five seconds earlier, the driver maintained a speed well above the limit, without performing any braking maneuver. Subsequently, he made a turn at a speed incompatible with road safety, which caused understeer of the vehicle and loss of control, invading the sidewalk and endangering the lives and physical integrity of several pedestrians, some of whom had to move away hastily to avoid being run over.

Finally, the defendant ran over three minors, causing them serious injuries. The healing periods were 277, 376, and 91 days, respectively, with sequelae in all cases. The Prosecutor's Office understands that these facts constitute a crime of reckless driving under article 380.1, in conjunction with three crimes of serious imprudent injury under 152.1.1º and 147.1, all of them from the Penal Code.

Sentences requested and civil liability

The Public Prosecutor's Office requests that the accused be sentenced to 1 year and 9 months in prison, with special disqualification from exercising the right to passive suffrage during the sentence, as well as the deprivation of the right to drive motor vehicles and mopeds for 5 years.

The deprivation of the right to drive motor vehicles and mopeds for a period exceeding two years implies the loss of the administrative authorization to drive, in accordance with article 47.3º of the Penal Code.

In the scope of civil liability, the Prosecutor's Office requests that the accused compensate the three minors with 42,092.75 euros; 36,468.85 euros; and 4,915.41 euros, respectively. Likewise, it claims that he compensate the Sespa with the amount to be determined in the execution of the judgment for the expenses derived from the healthcare provided. Of all these sums, plus the corresponding legal interest, the insurance company will be directly liable, with the accused being jointly and severally liable with the insurance entity within the limits of the compulsory insurance.
