Andalusia claims the maximum rigor of its Housing Law and expects an agreement with the Government

Andalusia defends the rigor of its Housing Law and trusts in resolving with the Government the technical discrepancies to avoid an appeal before the TC.

The Ministry of Development, Territorial Planning and Housing maintains that Law 5/2025, of December 16, on Housing of Andalusia, "has been made with the utmost rigor", and maintains confidence that, "if there is any doubt on the part of the Government of Spain" about its content, "they will be clarified and resolved within the bilateral commission" that brings together both administrations, with the aim of avoiding a possible appeal by the central Executive before the Constitutional Court (TC) against said norm.

Sources from the department headed by Rocío Díaz have indicated to Europa Press this Monday that the Government of Spain and the Junta de Andalucía have decided "to initiate negotiations" to try to stop an appeal by the central Executive before the TC due to the "discrepancies" existing around 16 articles and one provision of the Andalusian law, approved in the Plenary Session of the autonomous Parliament on December 2, 2025 with the support of the Popular Group and the vote against the opposition groups.

The "discrepancies" between both administrations affect articles 4, 13, 14, 24, 31, 40, 49, 50, 51, 52, 63, 64, 66, 89, 90 and 96, as well as the third final provision of the rule, as stated in an agreement of the Subcommission for Regulatory Monitoring, Prevention and Resolution of Disputes of the Bilateral Cooperation Commission General State Administration-Autonomous Community of Andalusia, dated March 23 and published this Monday, April 13, in the Official State Gazette (BOE) and in the Official Gazette of the Junta de Andalucía (BOJA).

The document is signed by the Minister of Territorial Policy and Democratic Memory, Ángel Víctor Torres, and by the Minister of Health, Presidency and Emergencies of the Andalusian Government, Antonio Sanz.

From the Ministry of Development they emphasize that the Housing Law of Andalusia "has been made with the utmost rigor, in a process that has had much dialogue and, at the same time, has been meticulously supervised" by its "legal services".

In the same vein, the department headed by Rocío Díaz assures that they are "sure" that, "if there is any doubt on the part of the Government of Spain", these "will be clarified and resolved within the bilateral commission".

Likewise, the Regional Ministry of Development emphasizes that "the discrepancy presented by the Ministry of Territorial Policy does not go into the substance of the Andalusian Housing Law, but rather into formal and technical issues".

"It is not an issue that affects the regulatory framework that we have been designing hand in hand with the sector, social and economic agents, and parliamentary groups," they have concluded from the Ministry of Housing.
