Junts, willing to modulate the ‘blow’ to the Property Registry of its ‘Friendly Administration Law’

Junts is willing to modulate the impact of its ‘Friendly Administration Law’ on the revenues of the Property Registry. The bill is being examined this Wednesday in the Senate, which votes on its consideration, but those of Carles Puigdemont are already advancing their intention to propose changes.

According to sources from this formation inform Democrat, if they obtain the endorsement of the Senate to process the initiative, they will propose amendments to introduce nuances regarding the Property Registry.

These sources indicate that this willingness to introduce changes will be publicly conveyed by Joan Baptiste Bagué, Junts' fiscal spokesperson in the Upper House, during the debate of the initiative in the Plenary.

The proposal suggests several legal changes to ensure that public bodies provide digital certificates and documents and exempt the citizen from having to resubmit documentation already provided in their administrative procedures.

In the case of the Property Registry, the bill proposes to modify the Mortgage Law and its regulations to establish that, once a digital note has been issued, it is not necessary to issue new ones if there are no changes, without any cost.

Digitized 100% for two years

This approach puts the Registry's income in check, which charges just over ten euros for each simple note issued. The reaction has not been long in coming and the registrars have transferred allegations.

Among them, that digitalization is already a reality in the Property, Commercial, and Movable and Immovable Property Registries. And it is, furthermore, guaranteed by Law 11/2023, which transposed several European directives and digitalizes the notarial and registry system. 

The obligation to have these digitized records came into force on May 9, 2024, so it will soon be two years since this transformation, which had already been previously advanced in the Commercial Registry.

From Junts they acknowledge these contacts and accept the approach conveyed by the property registrars in this regard, understanding that this digitalization exists.

Will arrive at Congress with the endorsement of the PP

These changes, in any case, will be discussed first in Congress, to which it will arrive with the endorsement of the absolute majority of the Popular Party in the Senate.

The ‘populars’ will support the taking into consideration of this bill, as sources from this group, who at the beginning of the week admitted doubts about what to do, informed Demócrata. Their vote is crucial, since the absolute majority they hold in the chamber grants them power of veto.

The taking into consideration, in any case, is only the first step of a procedure for which many milestones would still remain to be met. The initiative would enter Congress and would remain awaiting that the Bureau of the Lower House, controlled by PSOE and Sumar, decided to close the deadlines to register a total amendment first, and then partial amendments.

It is in this second term that would allow to introduce the corrections that Junts proposes regarding the Property Registry.
