Junts has registered this Thursday before the Council of Statutory Guarantees (CGE) a request for an opinion on the compliance with the Constitution and the Statute of the proposed law that modifies the urban planning law to limit speculative housing purchases. This is an initiative promoted by the Comuns and agreed upon with the Govern that was scheduled to be debated this very Thursday in the Parliament.

The submission of this resource before the CGE, to which the one formulated by the PP also adds, implies that the definitive debate of the proposed law is postponed. The text cannot be submitted to a vote in the plenary of the Parliament until the statutory body issues its non-binding opinion, for which it has a period of one month. Consequently, the processing will not resume in the Catalan Chamber until the next session period, already at the end of September or in October.

In its writing, Junts argues that the proposal of the Comuns violates the right of property recognized in the Constitution, as well as various principles of the Statute and the Magna Carta related to the freedom of enterprise, the free movement and establishment of people and goods, in addition to the principle of legal certainty.

The party also defends that the Generalitat cannot use urban planning regulations to regulate matters that are the responsibility of civil law, and considers it inappropriate that the proposal has been processed through the single reading procedure in the Parliament.

The legislative initiative aims to limit the acquisition of properties in areas of tense residential market when the objective is to resell them in the short term or to allocate them for tourist or seasonal rental, allowing only the purchase for habitual residence or for rental at limited prices. The responsibility for applying it will fall on the municipalities.

The Govern and the Comuns had agreed that the norm would come into force before August, but the resource before the CGE delays the final vote. In addition, PSC-Units, ERC, and the Comuns have not yet reached a definitive agreement on the amendments to the text.
