The man accused of assaulting his ex-partner with a knife in broad daylight in Gijón last Friday, who was then arrested and placed in provisional detention awaiting trial for those events, has been sentenced this Wednesday to nine months in prison for violating the restraining order that was in effect weeks earlier.

According to a press release from the Gijón Area Prosecutor's Office, the hearing was held this Wednesday at the Gijón Court of First Instance, plaza number 3, where the defendant reached a plea agreement with the Public Prosecutor's Office.

The prosecutor's document details that the accused was subject to a measure issued by the women's violence section of the Gijón Court of First Instance, plaza number 1, on July 28, which prohibited him from approaching within 200 meters of his ex-partner, her home, or her workplace, as well as maintaining communication with her by any means, for a period of 16 months.

Despite this prohibition, the man, deliberately, contacted the victim via mobile phone multiple times between July 31 and August 3, sending her messages, audio recordings, and videos.

Additionally, on the 4th, around 11:05 a.m., he followed her down the street, to the point that the woman had to ask for help from a third person at the place where she took refuge. The accused then passed by and "laughed mockingly," according to the Prosecutor's Office, which emphasizes that this behavior caused fear in the victim.

The public prosecution classified these events as a continued crime of breach of sentence in the context of violence against women, in accordance with articles 468.2 and 74 of the Penal Code.

After accepting the nine-month prison sentence, the prosecutor requested its full enforcement and opposed the suspension of the sentence for the accused.

The Prosecutor's Office also recalled that the man remains in provisional detention without bail, initially, and without prejudice to the possibility that this qualification may be modified, for an alleged crime of attempted homicide and another of breach of sentence, in relation to the assault that allegedly took place last Friday.
