The number 13 court of the Instruction Section of the Court of Instance of Málaga, on duty, agreed on the night of last Sunday to the provisional imprisonment, communicated and without bail, of the man arrested for the alleged homicide of his roommate in the Málaga capital.

According to what has been indicated by the Superior Court of Justice of Andalusia (TSJA), the detainee is being investigated for an alleged crime of homicide and it will be the number 6 court that takes over the continuation of the judicial instruction of the matter.

Along with the measure of imprisonment, the duty judge ordered that the arrested be examined by the forensic doctor, with the aim of obtaining a technical assessment of his mental state.

The deceased man, 52 years old, was found dead and with evident signs of violence on the morning of Thursday, August 13. The alleged perpetrator of the aggression, 32 years old, self-incriminated himself for the homicide during the statement-taking procedure carried out in police premises, acknowledging that in the days prior to the victim's death he had hit him several times, without the latter seeking medical attention.

Both, the victim and the alleged aggressor, lived in the same home along with two other men, in a house located in the Bailén Miraflores district of Málaga capital. On the morning of August 13, one of the residents of the apartment —different from the one ultimately detained— alerted emergency services upon noticing that his friend was not breathing.

After the health services certified the death of the person who did not respond to stimuli inside the house, agents of the National Police activated the protocol for deaths with signs of criminality, upon observing in the corpse bruises compatible with a violent death. Subsequently, Scientific Police and Judicial Police carried out the corresponding ocular inspection.

The autopsy performed on the body confirmed that the cause of death was polytrauma. The Homicide Group of the Provincial Police Station took over the investigation of the case.
