Ortega Smith announces legal actions against his “arbitrary” expulsion from Vox

The former leader of Vox Javier Ortega Smith has indicated this Thursday that he will take his "arbitrary" expulsion from Vox before the courts, after the formation has confirmed his departure from the party, maintaining for the moment his condition as a deputy in the Congress and spokesperson in the Madrid City Council.

In a message published on his profile on the social network X, Ortega Smith has stressed that his definitive expulsion, backed by the National Executive Committee (CEN) after rejecting his appeal, is "illegal, a violation of his fundamental rights, arbitrary and arrogant".

"The illegality that your violation of fundamental rights, arbitrariness, and arrogance entails will be resolved in the courts of Justice," he wrote. "Vox was founded to combat all this," he added.

Vox defends the procedure

For its part, Vox has maintained that the expulsion of Ortega Smith is the outcome of an internal file that they have described as "rigorous and serious", processed "in accordance with the most demanding canons of the Rule of Law". The administrative appeal was the last avenue left to the politician to stop his expulsion.

The decision to resort to legal action could delay his dismissal as spokesperson for the municipal group in Madrid and, in practice, prevent Arantxa Cabello, designated by the leadership, from immediately assuming the Spokespersonship of the formation of Santiago Abascal in the Palacio de Cibeles.

The Guarantees Committee of Vox communicated at the beginning of March the expulsion of Javier Ortega Smith after considering that he had incurred in a "very serious infraction" by blocking his replacement in the spokespersonship of the Madrid City Council, which motivated the opening of a file for disobedience and his suspension of membership.

In view of this, Ortega Smith reiterated his purpose to continue at the head of the municipal group until the end of the mandate, foreseen for May 2027, understanding that "it is the legitimate thing". Also immersed in expulsion files are the councilors close to Ortega, Carla Toscano and Ignacio Ansaldo.

Furthermore, Ortega has filed a complaint before the Agencia Española de Protección de Datos (AEPD) for the alleged leak to the media, by the Comité Ejecutivo Nacional and the Comité de Garantías, of the information related to his expulsion file.
