A 21-year-old young man faces a request for ten years in prison accused of sexually assaulting a friend when she was 15 years old and he was 18. The trial was held this Monday at the Jaén Court, in a hearing where the defendant rejected all charges and insisted that everything is "a lie."

The events took place on December 24, 2023, between 4:00 PM and 5:00 PM, at the minor's home. The complainant, the accused, a friend of his, and another 13-year-old girl went there.

According to the young woman’s account before the court, they were taking shots at the house and at one point agreed to form pairs and spread out to different rooms. Later, the boys changed rooms and, according to the Prosecutor's Office's statement, the defendant, "driven by the desire to satisfy his sexual desire," got into bed with the minor and ended up sexually assaulting her.

The victim explained that when the events occurred, she was "in shock" and did not imagine that the accused would behave that way with her that day.

The young man, on the contrary, defended that "there were neither touches nor approaches" and stated that he was interested in the 13-year-old girl. He indicated that it was his friend who suggested changing partners and that he accepted, but that "nothing happened" in the room.

The defendant acknowledged that he got into bed with the complainant, who, as she herself admitted in the hearing, was "a bit tipsy" from the alcohol, although he reiterated that there was no physical contact between them. "I didn't even touch her, I didn't get close to her," he stated before the court.

The other minor present in the house testified that when she entered the room, she found them both in bed, with her friend crying and her clothes disheveled, which is why she slapped the accused.

The episode ended when the minor's father returned home and expelled them from the house upon seeing them in the rooms. The young woman did not report what happened until almost a month later, when she told her father and the complaint was filed. She explained, via videoconference, that she did not do it earlier because she was not feeling well emotionally and feared that her boyfriend would reject her if he knew what had happened.

In addition to the prison sentence, the Prosecutor's Office requests a measure of supervised release for ten years, which would include the prohibition of approaching the victim, her home, or her workplace within 500 meters, as well as the prohibition of communicating with her by any means during the same period.

The public prosecution also requests special disqualification for ten years to practice any profession, trade, or activity, paid or not, that involves regular and direct contact with minors.

The trial has been concluded for sentencing.
