A court in El Ejido (Almería) has decided to provisionally release on bail two of the suspects belonging to the same clan for the shooting that occurred just over a year ago in the Transport City of La Mojonera (Almería), in which a man was injured by gunfire.
According to judicial sources cited by Europa Press, a bail of 10,000 euros has been set for each of the accused for an alleged crime of attempted homicide and illegal possession of firearms, within the framework of the proceedings being handled by the judge of the First Instance and Instruction Court number 6 of El Ejido.
The magistrate accepts the request made by the defenses of the suspects, to which the Prosecutor's Office adhered, after they were imprisoned on October 30 of last year. The decision is based on the delays that the procedure has due to its complexity and on the reduced flight risk of the defendants, for whom the obligation to appear in court every 15 days, the withdrawal of their passport, and the prohibition of leaving the national territory have been established.
In his ruling, the judge refers to circumstances external to both the suspects and the judicial body itself when obtaining certain evidence, so that international proceedings aimed at locating one of the two victims of the events are even recorded.
According to the investigation collected in the case, the truck driver and a second driver were resting on September 21 of last year in the cabin of the vehicle when they detected the presence of a third person armed with a knife, so they alerted 112.
Moments later, three vehicles arrived in the area whose occupants began to assault them and tried to run over one of them. During the escape, which was recorded by several security cameras, the truck driver was shot multiple times, causing him injuries.
In this context, the statements of the victims themselves and the witnesses, along with the identification parades and the recordings analyzed by the Civil Guard, currently constitute the main evidence for the identification of the alleged perpetrators.
As part of Operation 'Marmolistas', Civil Guard agents arrested the suspects of assaulting the truck to rob its drivers, who had heard noises coming from the cargo area of the vehicle.
Upon going out to check what was happening, they encountered a man inside the truck, who began to "threaten them with a large knife," as well as a woman outside, who was performing "surveillance duties."
It was then that several cars began to arrive whose occupants would have launched themselves to "attack the victims, using various weapons such as clubs and metal chains."
Three run-overs and a shot
In light of the situation, the truck drivers tried to leave the place, although one of them was reached and beaten. According to investigators, during the chase "he was run over up to three times" before the arrival of another vehicle, from which a person descended and fired several shots with a short weapon at the victim.
The investigations by the Civil Guard led to the supposed perpetrators, who would belong to the same clan dedicated to "committing robberies in the area."
The arrested individuals were initially charged with attempted murder, robbery with violence, and illegal possession of weapons, among others. Additionally, one of them had an outstanding warrant for search, arrest, and imprisonment.
During the searches carried out, two short firearms and a 12-gauge repeating shotgun were seized, all of them lacking a license. It was also confirmed that the shotgun had been stolen in a burglary in El Ejido in 2022.
Furthermore, different types of nine-millimeter ammunition and 12-gauge cartridges were located, as well as bladed weapons such as knives and daggers, and blunt objects, including clubs and the chain that was allegedly used in the assault. During the entries and searches, illegal connections to the electrical network were also detected, for which they are also charged with a crime of fraud.
