The jury that since this Monday is judging J.J.S.A., accused of ending his wife's life with stab wounds in 2022 in Escalona (Toledo) when she was pregnant and about to give birth, has unanimously found him guilty of the crimes of murder and abortion.
Prosecution's Account
According to the Public Prosecutor's Office's brief, J.J.S.A. was married to M.E.B.C., 34 years old, and they both resided in a home in Escalona with their two minor children, A., 13 years old, and B., 14 years old.
The Prosecutor's Office details that M.E.B.C. was having an extramarital affair — known and accepted by the accused — with M.A.G., with whom she was pregnant at the time of the events, with a gestation of 40 weeks.
Around 7:00 PM on December 28, 2022, after several previous attempts frustrated by fear of possible reprisals from her husband, M.E.B.C. decided to leave the family home with her two children to go live with M.A.G., so they packed their bags and began loading them into the car.
According to the prosecutor, the accused did not accept that his wife was leaving him and, around 8:00 PM that same day, when the minors were outside the house taking out their belongings, he closed the house door with the intention of killing her, or assuming that such an outcome could occur, and thereby also causing the abortion of the fetus she carried in her womb.
While both were in the front yard of the house, suddenly and taking advantage of the victim's lack of reaction, the indictment states that the defendant inflicted eight stab wounds on M.E.B.C. in the abdominal area and on her back. As a result of these wounds, the woman died, as did the fetus, even though medical personnel dispatched to the scene performed an emergency cesarean section and attempted to resuscitate the baby.
The stab wounds directed at M.E.B.C. were located twice in the left infrascapular region, another below the left deltoid area, three in the left abdomen, and two incised wounds in the lower third of the left forearm, none of them with signs of defense.
The prosecutor maintains that, after the assault, the accused, "guided by contempt for his wife and his unwillingness to respect her free decision to resume her romantic life," insulted her because she was "going to have a child with someone else."
Next, the accused threw the knife into the yard of the adjoining house with the intention of disposing of the weapon, although he acknowledged to his son A. that he was the perpetrator of the murder and the abortion, telling him that "he deserved it", and he also admitted it to his daughter B. and the neighbor P.C.C.
At that moment he asked that the Civil Guard be notified, admitting that he knew perfectly well what he had done and that he was not going "anywhere". Since December 30, 2022, the accused has remained in provisional prison for these events.
