The Ombudsman, Ángel Gabilondo, has presented a protection resource before the Constitutional Court against the resolution of the Supreme Court that suspends the voting right of those who have obtained nationality through the so-called 'grandchildren's law', contemplated in the Democratic Memory Law.

According to the institution, in a note released this Friday, the requests made by "individuals and entities" have been attended to, and extremely urgent measures have been requested from the Constitutional Court, in addition to an express ruling on the interpretation made by the Supreme Court regarding "the suspension of the fundamental right to vote" of the affected individuals.

The Ombudsman emphasizes that the decision to challenge the agreement of the high court has been made after studying the order of the Administrative Litigation Chamber issued on October 12, with the aim that the newly naturalized "can, if they wish, exercise their right to active suffrage in the upcoming general elections."

The presentation of this resource takes place just six weeks before the celebration of the general elections, scheduled for November 29. If the Supreme Court's criterion is maintained, those who have acquired nationality under this regulation would be excluded from participating in that electoral event.

The so-called 'grandchildren's law' is part of the Democratic Memory Law and opens the way to obtain Spanish nationality, among other cases, for the descendants of those who were forced into exile during the Civil War and the Franco dictatorship for political reasons, and whose children or grandchildren lost their nationality as a result of that exile.
