The Prosecutor's Office has shown its rejection of the request for provisional release presented by the defense of the father of the baby allegedly mistreated by his parents in Barcelona, as confirmed by Europa Press through sources from the public ministry.

The Public Ministry has requested the head of the Court of Violence against Children and Adolescents in the Catalan capital to maintain the precautionary measure of provisional imprisonment for the father, as it does not perceive "any alteration that justifies the mitigation of the measure."

The public ministry argues that the reasons that led to the imposition of preventive detention remain in force, including the risk of flight and obstructing the work of justice, which is why it considers that the measure is "suitable, necessary, and strictly proportional" to the seriousness of the crimes being investigated.

The parents were arrested in March 2025 and the baby's mother obtained provisional release on May 7, after spending a month and a half in preventive detention, while the Barcelona Court decided to maintain the deprivation of liberty for the father.

At that time, the Prosecutor's Office had already positioned itself against his release, considering that the injuries to the baby posed a vital risk to his life, "potentially constituting the facts of a crime of attempted homicide," without this criminal qualification absorbing the rest of the behaviors attributed to both parents: habitual mistreatment, very serious injuries, and sexual assault.

The mother requests the filing of the case

In parallel, this week the mother has requested the Court of Violence against Children and Adolescents in Barcelona to file the case against her, after the father of the minor and ex-partner exonerated her in his last voluntary statement before the judge on October 1.

In a document sent to the court, her defense requests that she be removed from the proceedings as they understand that there are no indications linking her to the facts being investigated.
