The Supreme Court has decided to end the investigation opened against the Member of the European Parliament and leader of Se Acabó la Fiesta (SALF), Luis 'Alvise' Pérez, for the publication on his X profile of a supposed false coronavirus test attributed to the president of Catalonia, Salvador Illa. The high court concludes that there are no "sufficient indications" to request a waiver from the European Parliament.

In an order to which Europa Press has had access, the investigating judge, Javier Hernández, explains that he has not found indications of an offense of falsification "with the minimum consistency" necessary to file the waiver and move forward with the prosecution of 'Alvise'.

With regard to the possible insults, Hernández argues that the conduct analyzed did not reach the threshold of "humiliation, serious contempt, or discredit" required to activate the criminal route, although he leaves open the possibility that civil actions may be brought to defend the right that is considered to have been violated.

In any case, the judge emphasizes that dismissing the criminal route "does not mean, by any means, that Salvador Illa does not have the right to protect his honor and to respond to conduct that unjustly undermines his reputation or his own regard".

"What I do state is that in this case the criminal route is not the appropriate one," adds the investigating judge, who also specifies that the decision may be appealed both to him and to the Supreme Court's Criminal Chamber.

Once this case file has been closed, the Supreme Court keeps open five different investigations into 'Alvise': one into the alleged illegal financing of his political group; another into the alleged harassment of the delegate prosecutor for crimes of hate in Valencia, Susana Gisbert; another into alleged harassment and disclosure of secrets against the other two Members of the European Parliament elected on the lists of SALF; another into alleged coercion against the former mayor of Algeciras (Cádiz), José Ignacio Landaluce; and a final one into a possible offense of public disorder related to messages disseminated during an agricultural protest.
