Vox has filed a complaint against those responsible for Adif for alleged offenses of negligent homicide and negligent injury in connection with the railway accident that occurred in Urda.
According to the document filed on behalf of Vox before the Court of First Instance and Instruction No. 1 of Orgaz (Toledo), as reported by Europa Press, the party is exercising the popular action in this case.
The complaint is directed against those responsible for Adif and, specifically, against the operator or operators of the Atocha Traffic Control Center who gave the green light to the resumption of railway traffic after the failure of the LZB system occurred.
Likewise, the document extends to their direct hierarchical superiors on that shift and to those who, within the entity, "had assigned to them the definition, implementation and supervision of the degraded operation procedure and safety in circulation on the stretch".
The complaint states that the detailed identity of these people is still unknown and that it is intended to clarify it through the requested proceedings, for the alleged commission of an offense of negligent homicide under article 142 of the Penal Code and offenses of negligent injury under article 152 of the Penal Code, in conjunction, in addition to those that may arise from the investigation.
For this reason, Vox is requesting the opening of preliminary proceedings and the carrying out of the requested investigative actions. In particular, it is requested that Adif be required to provide, within the shortest time set by the Court, the first and last name, position, professional category and authorization of the operators, shift supervisors and circulation managers of the Atocha Control Center who worked between 7:00 and 11:00 a.m. on the day of the events.
