The parents of Sandra Peña, the 14-year-old minor who died last October in Seville, will appeal the provisional dismissal of the lawsuit they filed against those responsible for the educational center where their daughter studied, after a court ruled out, for now, the existence of criminal liability on the part of the school.

The decision was announced by the family after learning of the judicial order that agreed to the provisional dismissal of the case, a resolution that rejects the existence of sufficient evidence to support charges of negligent homicide or degrading treatment by the educational center in relation to the minor's death.

The parents have publicly expressed their disagreement with this decision and have confirmed their intention to appeal it, considering that the resolution does not include elements that, in their opinion, should have been taken into account in the investigation.

The judge rules out criminal liability for the school

The judicial order, in line with the Prosecutor's Office's criteria, maintains that the school took measures after learning of the situation reported by the family and concludes that there is no sufficient causal link between the school's actions and the minor's death.

The resolution also refers to the investigation that remains open in the juvenile justice system regarding the actions of three students identified as alleged perpetrators of school bullying, a separate proceeding from the one now dismissed concerning the educational center.

The dismissal now known is provisional, meaning it can be appealed by the parties.

The family announces they will move forward

Sandra Peña's parents have conveyed their intention to continue with legal actions and appeal the resolution.

The family maintains its disagreement with the assessment made in the order and argues that there are elements that justify the investigation continuing on this judicial path. In addition to the judicial front, the juvenile justice proceeding and administrative actions related to the case remain open.

The announcement of the appeal keeps the judicial process initiated by the family open, as they seek to have the conclusions reached so far regarding the school's actions reviewed.
