The First Chamber of the Provincial Court of Ciudad Real is scheduled to try next June 2 the administrators of the company 'Multiservicios La Mancha S.L.'. Both sit on the bench accused by the Public Prosecutor's Office of a crime of risk against worker safety and a crime of manslaughter due to serious negligence, following the death of an employee who fell from the roof of an industrial building in Tomelloso, despite being hired with the professional category of plumber.

According to the indictment of the Public Prosecutor's Office, to which Europa Press has had access, the events date back to April 2022, when two workers went to a building to replace several damaged panels on the roof.

The Public Prosecutor's Office details that the workers climbed to the top of the building using a ladder leaning against an adjacent construction and carried out the work without any collective protection measures having been designed, nor having been provided with the mandatory anti-fall harness or safety helmet.

During the course of the work, one of the employees stepped on one of the panels, which gave way, causing him to fall inside the building. As a consequence of the impact, he suffered severe traumatic brain injury and died at the scene.

The Public Prosecutor's Office argues that the accident originated from an "inadequate task design," as working at height on the roof was not contemplated in the risk assessment, and only generic preventive measures were established, without specific reference to this type of intervention.

The public prosecution maintains that the two managers of the company, in their capacity as administrators, were fully aware of the inherent danger of working on a roof located more than eight meters above the ground and, even so, allowed the work to be carried out without adequate protection measures.

Consequently, the Public Prosecutor's Office seeks for each of the accused the imposition of one year in prison for the crime of risk against worker safety and an additional one year and six months for the crime of manslaughter due to serious negligence.

In the area of civil liability, the Public Prosecutor's Office claims compensation for the widow and the two minor children of the deceased worker.

Specifically, the prosecution requests 177,620 euros for the wife, 184,844 euros for the son, and 151,178 euros for the daughter, amounts already increased by 30% due to the crime of risk against worker safety.

Likewise, it requests 57,044 euros for each of the victim's parents and 21,391 euros for each of their siblings, so that the amounts included in the indictment amount to a total of 670,515 euros, designating the commercial entity as subsidiarily civilly liable.
