The Minister of the Interior, Fernando Grande-Marlaska, has announced that he will launch a specific protocol in the first half of July so that migrant trans people can modify their name and sex on their immigration documentation.
During the government control session in the Senate, the head of the Interior explained that his department is working on a mechanism that addresses the current difficulties in processing these changes in administrative records.
Grande-Marlaska responded in this way to the question from the senator of Más Madrid, Carla Antonelli, who was demanding explanations for the delay in the implementation of article 50 of the Trans Law, referring precisely to migrants.
Before the Upper House, the minister admitted that the current system is not offering an adequate solution to the migrant community and acknowledged the problems faced by those who cannot carry out the rectification in their country of origin.
The head of the Interior stressed that, although his ministry is already applying the regulations in various areas, it is essential to provide the Immigration Offices and the National Police with a clear and operational instrument.
As indicated, the new protocol is being developed in coordination with the various administrations involved "to ensure its effective application from the very first moment."
The procedure will take as a reference article 44 of the Trans Law, which regulates the registry rectification for people with Spanish nationality, adapting it to the reality of those who have residence or stay permits in Spain.
The National Police, a key player in processing
Regarding practical application, Grande-Marlaska has announced that the National Police will be responsible for promoting the rectification of immigration documents, once it is confirmed, in coordination with the Ministry of Foreign Affairs, that the person cannot carry out the procedure in their country.
The change will be reflected in the Central Register of Foreigners and will be transferred to the Foreigner Identity Card (TIE) or the corresponding police document. "So it will be clarified in a concrete and definitive way so that the indicated right is acquired," the minister emphasized.
For her part, Senator Carla Antonelli has valued the response of the head of the Interior Ministry and has thanked "his firm commitment" and that "finally" trans migrant people can see "their identity recognized". In her opinion, "it is about justice" and "about saving absolutely unnecessary humiliations".
