The Court of Málaga has imposed a sentence of 16 years in prison on a man for threatening and attempting to kill his ex-partner, whom he stabbed and tried to throw from the balcony, as well as for assaulting one of his daughters, who intervened to protect her mother, and another man present in the home. The ruling also establishes a restraining order with respect to the victims and the payment of compensation of 165,400 euros to his ex-wife and 97,200 euros to his daughter.

As stated in the sentence, the convicted man, in an irregular administrative situation in Spain and with an expulsion order in effect, had been the victim's romantic partner 19 years ago. The relationship had ended more than five years before the events, and they had two adult children in common, one of whom was the one injured when she intervened.

The woman first moved to Spain for work reasons and, three years later, the accused arrived, who "became obsessed with his ex-partner, constantly insisting on resuming the relationship, within the framework of continuous fits of jealousy," according to the ruling of the Eighth Section of Málaga, to which Europa Press has had access.

In that context, he directed expressions at her such as "no one is going to make a fool of me, I'm going to kill you, I'm going to slit your throat." Since approximately July 2023, they had not seen each other, that being the last occasion on which the victim had agreed to meet him, always in public places due to the fear he generated, the resolution details.

On the day of the events, the defendant contacted his daughter under the pretext of visiting his ex-partner to give her a gift for her birthday. He showed up at the home where the two women were, and the victim agreed to receive him "despite her fear, she agreed to see him." The three had a "tense" conversation for a few minutes, until the daughter left the room.

At that moment, the Court recounts, the defendant and the woman were left alone, and suddenly, the man, "with the intention of ending her life, suddenly and unexpectedly lunged at her, hit her several times in the face, threw her onto the bed" and, "with the clear intention of throwing her to her death through the window, he grabbed her forcefully and threw her onto the ledge of the open window."

"The accused arrived 'to hang his body up to his waist', while repeating: 'No one makes a fool of me'. Upon hearing the 'desperate' screams of the victim, his daughter entered the bedroom and tried to prevent her father from throwing her out the window. A man who was in the house with other people also intervened to try to stop the assault.

However, the Court indicates, 'the intervention of these people did not stop the defendant', who, to carry out the alleged 'premeditated criminal plan to kill his ex-partner', took out a knife he was carrying hidden and 'went straight towards her, although the man, who received a stab wound to the leg, got in his way'.

Next, according to the Chamber, the accused continued with that purpose and lunged at the woman, to whom he delivered 'a stab wound to the neck and directed successive knife blows to the chest and heart area'; at which point the daughter placed herself over her mother to try to shield her.

Despite this, the defendant, 'with the intention of attacking, indifferently also against the physical integrity of his daughter', continued to attack both with the knife. At that moment, he was subdued and arrested by agents of the Local Police Force of Malaga, who also located another bladed weapon hidden in the aggressor's trousers.

As a consequence of the assault, both women suffered serious injuries, especially the ex-partner, who required 104 days to heal and has lasting effects. For the Chamber, the facts constitute a crime of attempted murder, another of serious threats, and an aggravated crime of injury with a dangerous instrument.

Along with the prison sentence and compensation in favor of the victims, the court decrees the prohibition of approaching them and a supervised liberty measure of 20 years, which will be executed once the prison sentence is served.

The sentence was handed down after the agreement reached between the accused and his defense with the prosecution, accepting the legal classification, the narration of the facts, the authorship, and the penalties requested by the parties involved.
