The National Court has agreed to open proceedings against the Israeli prime minister, Benjamin Netanyahu, and part of the Israeli military leadership following a complaint filed by the political party Iustitia Europa. The lawsuit points to alleged crimes of war crimes, illegal detention, and coercion.

The complaint is also directed against the Chief of Staff of the Israel Defense Forces, Herzi Halevi, as well as against other military commanders yet to be identified, including operational commanders on the southern front of Lebanon.

Spanish soldier detained

The origin of the judicial proceeding is found in an incident that occurred on April 7, when Israeli forces intercepted a logistical convoy of the United Nations Interim Force in Lebanon (UNIFIL). The convoy was transporting food and supplies destined for troops deployed in the area and, during the operation, a Spanish soldier was detained for less than an hour.

The soldier was later released after formal protests from the Spanish Government, which, through the Minister of Defense, Margarita Robles, conveyed its “most energetic protest” to both the United Nations and the Israeli Executive.

From Iustitia Europa they maintain that what happened does not constitute an isolated episode, but rather is part of a pattern of “growing harassment” against the peacekeeping forces deployed in Lebanon. In their statement, they denounce an alleged “systematic disregard” for the rules of International Humanitarian Law.

The opening of proceedings does not imply immediate formal charges, but it does activate a phase of judicial investigation in which the National Court must determine if there are sufficient indications to advance the procedure. The case adds a new international judicial front to the Israeli Government's situation amid escalating tension in the Middle East.
