The Secretary of State for Public Function has given the green light to new instructions for managing the partial retirement of labor personnel included in the IV Single Agreement of the General State Administration (AGE), with the aim of adapting this procedure to the recent changes introduced in Social Security regulations.

The resolution, published this Tuesday in the Official State Gazette (BOE), repeals the guidelines that had been in force since February 2022 and sets the framework for processing both ordinary partial retirement and early partial retirement for labor personnel.

As stated in the BOE, this revision adjusts to the novelties incorporated by Royal Decree-Law 11/2024, which modified the legal regime of partial retirement and the relief contract.

In particular, the text establishes that full-time permanent labor workers who meet the age, contribution, and seniority requirements provided for in Social Security regulations may opt for partial retirement.

In addition, the conditions for reducing working hours and hiring relief workers in cases of early partial retirement are specified, aligning these processes with the legal changes in force since April 1.

The norm also incorporates the criteria agreed upon between the Administration and the trade union organizations within the Negotiating Commission and the Joint Commission of the IV Single Agreement.

The text states that the new instructions will begin to apply the day after their publication in the BOE —that is, this Wednesday— and will repeal those issued by Public Function in February 2022.

That same Wednesday, at a press conference, UGT indicated that the conflict arising from the application of the new regulation of partial retirement for AGE labor personnel has been "unblocked" after the approval of this resolution.

The general coordinator of the Single Agreement in UGT, Alberto Pablos, indicated that the affected employees must re-submit the partial retirement applications that had been suspended in recent months, so that they can be processed according to the new procedure.

According to what has been explained, the delays accumulated during the last year originated from the lack of adaptation of Public Function to the modifications of Royal Decree-Law 11/2024 and has underlined that the new scheme will be advantageous both for those who access partial retirement and for the workers who sign the relief contracts.
