A court in Majadahonda has decided to dismiss the lawsuit filed by the wife of the President of the Government, Begoña Gómez, against Vito Quiles for an alleged assault that occurred in a venue in Las Rozas (Madrid) last April.
In a ruling to which Europa Press has had access, the magistrate orders the provisional dismissal, understanding that the facts cannot be proven to constitute a criminal offense, as the alleged conduct is "not appreciated in the recordings of the incident."
The judge emphasizes that, based on the images sent by the National Police Corps, the "objective existence" of the injuries reported by Gómez has not been demonstrated.
He details that the videos do not allow for confirmation that a "shaking" occurred or that Vito Quiles—defended by lawyer Juango Espina—had "surrounded the complainant with his arm."
"A struggle is recorded between the complainant and the defendant, in which the complainant is the one who sustains the main assault (of no criminal relevance) towards the defendant with the intention of expelling him from the premises," the magistrate's ruling states.
In her statement, Begoña Gómez maintained that Vito Quiles was a "media agitator" who intruded into her personal space, "aggressively questioning her about matters of public interest," as stated in the resolution.
The judge specifies that interference in the social sphere of a public figure can constitute both a crime and a civil offense, depending on the intensity and manner in which it is carried out.
In this regard, he indicates that it must be classified as an unlawful interference when personal or family privacy is violated, reserved aspects of private life are disclosed, or images are captured without permission, without a relevant public interest to justify it.
He adds that the conduct moves into the criminal sphere when the interference is "serious, continuous, or involves violence or threats, harassment offenses, or if the interference is insistent, repeated, and seriously alters daily life."
The magistrate highlights that, in the recordings, it is observed that, although Vito Quiles enters an establishment open to the public with "the clear intention of addressing" Begoña Gómez, she "leaves the premises immediately."
The events took place on April 29, when Pedro Sánchez's wife was in a cafeteria and Vito Quiles entered the venue, questioned her, and began recording her with his mobile phone.
Quiles himself later disseminated a video of the episode in which Sánchez's wife is seen trying to leave the place while two people accompanying her struggle with him to stop the recording.
Government sources pointed out at the time that the images were "edited" and that there was "a part that has not been published." They also stated that Quiles blocked Gómez's exit from the establishment in behavior they described as "harassment."
