The head of the Court of Instruction number one of Gijón has, in line with the position of the Public Prosecutor’s Office, ordered the imposition of precautionary measures for ten detainees in the context of the police operation related to Núcleo Nacional. These measures include the obligation to appear every Friday at the court, the prohibition on leaving Spanish territory, and the withdrawal of their passports.
As the magistrate explains, the events being investigated could, on a provisional basis, fall within the offences of incitement to hatred, criminal association, and unlawful possession of weapons in relation to the arrested persons, an initial criminal classification that could change as the investigation phase progresses.
With regard to the offence of unlawful possession of weapons, the judge specifies that, although most of the persons under investigation cannot be charged with possession of firearms because they have the relevant licences, during the police operation various prohibited weapons were seized, including brass knuckles and Taser pistols.
