The General Council of Notaries and the General Council of Colleges of Administrative Managers of Spain have launched a new professional interconnection system that allows certain notarial services to be provided entirely online, through administrative management agencies and using the Notarial Electronic Headquarters.
As the organizations have defended through a statement, this interconnection maintains all the legal guarantees and legal certainty required by the Spanish legal system.
At the presentation, held in Madrid, two real operations carried out entirely before a notary using this new system were shown live: the granting of a power of attorney between individuals and the incorporation of a limited liability company. Both actions were carried out at the Notarial Electronic Headquarters through videoconference, qualified electronic signature, and a secure connection with the Genoe platform.
The Genoe platform has been designed with a main objective: to bring legal and notarial services closer to citizens by leveraging the network of administrative managers present throughout the country, so that numerous legal acts can be completed without unnecessary travel and from any location.
"For many years, we notaries have been demonstrating that legal certainty does not prevent the dynamism required by today's society, without incurring costs, in time and money, or bureaucracy for SMEs, the self-employed, and citizens in general," stated the president of the General Council of Notaries, Concepción Pilar Barrio Del Olmo.
For his part, the president of the General Council of Colleges of Administrative Managers of Spain, Fernando Jesús Santiago Ollero, stressed that "true digital transformation consists not only in making procedures faster, but in making them more human, more accessible, and closer to those who have the most difficulty interacting with the Administration and with certain legal services."
Remote notarial services with professional support
The system will make it possible for both individuals and companies to initiate and complete certain notarial services from an administrative agency, from their own home, or even from abroad, always accompanied and advised by their administrative manager and with the impartial advice, legality control, and authorization of the chosen notary, through the notarial electronic headquarters, which has important security measures.
The connection between the Notarial Electronic Headquarters and the managers' headquarters incorporates advanced electronic identification and signature systems. In addition, it allows the issuance of digital certificates by administrative managers and notaries, both enabled as registration authorities, which guarantees the authenticity, traceability, and security of all operations carried out.
Among the acts and legal transactions that can be authorized online are the incorporation of companies, various notarial powers of attorney, revocations of powers of attorney, commercial policies, company modifications, certain deeds, and other acts that the law allows to be formalized by videoconference.
