A Sanxenxo Local Police auxiliary has been given a one-year prison sentence for having struck a man in the head with his baton who, according to the prosecution, would have intervened in a previous fight.
The conformity hearing took place this Thursday in the fourth section of the Provincial Court of Pontevedra. In the proceedings, the accused admitted what happened and accepted the one-year prison sentence, after the mitigating circumstance of reparation of damage was applied, having deposited about 1,300 euros in court in concept of civil liability.
According to the written submission of the Public Prosecutor’s Office, the events date back to the early hours of August 5, 2022, at which time the defendant was carrying out his duties as an auxiliary of the Sanxenxo Local Police.
The convicted man was trying to identify a young person who allegedly had taken part in a fight in the vicinity of the marina of this Pontevedra town, when the boy set off running and entered an exitless area.
Seeing himself cornered, the young man had to return in the direction of the officer, at which instant the latter drew his baton and struck him in the head, causing an injury that required the placement of staples for his recovery. Initially, the prosecution requested for the auxiliary a sentence of up to two years and three months in prison, but the sentence was finally set at one year.
