The Supreme Court has asked the European Parliament this Thursday for a fifth request for immunity waiver against Alvise Pérez in order to investigate him for a suspected offense of incitement to disorder in the February 2024 protests by farmers.
The magistrate Carmen Lamela has requested that the immunity of the Member of the European Parliament and leader of Se Acabó la Fiesta (SALF) be lifted for several messages published on his Telegram channel between February 6 and 10, 2024, in which he urged protesters to cut roads, block logistics centers, and paralyze cities.
The investigating judge considers that there are indications of an offense in those publications, which also referenced the lack of police officers to control the mobilizations. The messages, according to the magistrate, were not limited to expressing support for the farmers’ demands, but encouraged actions that could seriously disrupt public order.
The events occurred before Alvise was elected a Member of the European Parliament in the June 2024 European elections. However, the Supreme Court needs the European Parliament to authorize the removal of his immunity in order to continue the proceedings.
The Supreme Court archives the case for the false covid test by Salvador Illa
The high court has also agreed to archive the investigation against Alvise Pérez for disseminating a false covid test attributed to Salvador Illa, the current president of the Generalitat of Catalonia.
Magistrate Javier Hernández considers that there is insufficient evidence to attribute the drafting of the document to the Member of the European Parliament or to demonstrate that he knew it was false when he published it on Twitter.
Regarding the alleged offense of insults, the judge understands that the facts do not have the necessary seriousness to be pursued through the criminal route, although Illa may turn to the civil courts if he considers his right to honor has been violated.
Five requests for immunity waivers against Alvise Pérez
With this new request, the Supreme Court has already asked for five requests for immunity waivers against Alvise Pérez for different criminal investigations.
Among the cases that are open are the alleged illegal financing of Se Acabó la Fiesta, the alleged harassment of the hate crimes prosecutor of Valencia, Susana Gisbert, and the investigation into alleged offenses of harassment and disclosure of secrets against two Members of the European Parliament elected on SALF lists.
The high court is also investigating the alleged coercion of former Algeciras mayor José Ignacio Landaluce.
The new request must be examined by the European Parliament, which will have to decide whether to authorize the Supreme Court to continue the investigation into the messages disseminated during the agrarian protests.
