The process of Loterías y Apuestas del Estado (SELAE) distinguishes three operations: validating the participating bets, documenting the draw result, and conducting the scrutiny, which determines the winners and their prizes. The winning combination may be released before the complete distribution is available; therefore, knowing the numbers does not equate to knowing the final amounts.

1. Closing of participation

Before the draw, bets must be correctly registered in SELAE's systems, within the established schedule and conditions for that contest. Each participation is linked to its physical or digital receipt.

This prior validation defines which bets participate in the distribution: the scrutiny is performed on validly registered and participating bets, not on any ticket presented afterward. The rules of La Primitiva specify the start of the scrutiny once the draw has concluded.

3. Scrutiny and prize calculation

Once the draw is finished, the comparison of the winning combination with the participating bets begins. The scrutiny identifies the matches, counts the winners by category, and applies the corresponding economic rules.

• It checks the categories of six matches and, for the special category, its coincidence with the refund number.
• It determines the prizes for five matches plus complementary, five, four, and three matches, as well as refunds.
• It calculates the amounts per category and the destination of amounts to be accumulated as a jackpot.

The regulations published by the Treasury describe the scrutiny as the assignment of prizes through this comparison.

4. Checks and control

The consolidation of the distribution includes verifying the participating bets, contrasting the results, and verifying the number of winners and economic calculations. Reports are also generated and the corresponding records are safeguarded.

The Superior Control Board exercises the functions assigned by the rules regarding participation, prizes, and claims. This control should not be confused with a second drawing: it is about verifying the correct application of the result and the game rules.

5. Publication and timing

SELAE disseminates the combination and scrutiny through its official channels, including its website and its commercial network systems. There is no fixed deadline in minutes to complete all checks and publish the definitive distribution.

Therefore, the combination may appear first, followed by the number of winners, amounts, and jackpot. This separation is reflected in the Demócrata information, which distinguishes the known result from the scrutiny still pending.

6. Verification of the receipt

For the player, the last step is to check the receipt through official channels or an authorized point of sale. Reading the ticket allows verifying its correspondence with the draw and its winning status. Third-party publications serve as guidance; the definitive check must be done with SELAE.

To legally participate in La Primitiva, you must be of legal age, not be subject to a participation ban, and place a valid bet according to the game rules. If you participate online, you must also complete the identity and access controls required for your account. It is important to distinguish personal requirements from purchase and payout conditions.

1. Be at least 18 years old

Article 6.2 of the Law 13/2011 on game regulation prohibits minors from participating. Therefore, a minor cannot legally bet on La Primitiva, even with authorization from their parents or guardians: the law does not consider such authorization as an exception.

The same article includes restrictions related to capacity according to civil law and applicable judicial rulings. This provision should not be confused with an automatic prohibition for any person with a disability.

2. Not be subject to a playing ban

The law prohibits participation for those who have voluntarily requested to be barred from gaming and those prohibited by a final judicial ruling. The General Registry of Gaming Access Prohibitions allows checking these restrictions.

There are also prohibitions due to links with the operator or supervisory functions:

• Owners or significant participants of the operator, its management staff, and employees directly involved in game development cannot participate in games managed or operated by them.
• This restriction extends to their spouses or cohabitants and their first-degree ascendants and descendants. It also cannot be circumvented by playing through third parties.
• The law also includes certain officials of the regulatory body and personnel with inspection and control functions, with the family scope provided in its article 6.2.

Therefore, it is not an indiscriminate prohibition for any worker related to the gaming sector.

3. Place and pay for a valid bet

Besides meeting personal conditions, you must comply with La Primitiva's participation rules and pay the corresponding bet. The Resolution of July 23, 2002 set the price of each bet in this modality at one euro.

Participation must comply with the rules of prediction contests, not just selecting a combination. It is important to differentiate the effectively placed bet from a mere number selection.

4. Identify yourself when playing online

Royal Decree 1613/2011 regulates participant identification and prohibition controls. For account-based play, it establishes a unique active user per operator, with identity, tax identification, and residence data, whose truthfulness must be verified.

The Resolution of July 12, 2012 develops these verifications and requires declaring that one is not affected by legal prohibitions. True data and necessary documentation must be provided; indicating only a birth date is insufficient.

5. Distinguish nationality, residence, and payout

The general prohibition in article 6 does not require Spanish nationality. However, this does not guarantee access to any digital channel: its specific registration and residence conditions must be met.

Finally, buying and cashing are different procedures. The regulations contemplate identity and prohibition checks for prize payments; having a bet does not eliminate these controls.

The central regulation is Law 13/2011, of May 27, on game regulation, which establishes the framework for betting and other state-level games. State lotteries also have a regime reserved for certain operators. To identify the applicable regulations, it is useful to distinguish between lotteries, state bets, and games subject to regional competence.

1. General framework: Game regulation law

Law 13/2011, effective since May 29, 2011, and subsequently amended, regulates the organization, operation, and development of state-level gaming, especially through electronic, computer, telematic, and interactive channels. Its main contents are:

• Licenses and authorizations necessary to operate, as well as the requirements imposed on operators.
• Protection of participants, prevention of addictive behaviors, and access prohibitions, particularly for minors and excluded persons.
• Advertising, supervision, infractions, sanctions, and taxation of regulated activities.

Non-reserved activity requires the corresponding enabling title beforehand. A license granted by another state does not authorize operation in Spain by itself.

2. Specific regime for state lotteries

Law 13/2011 itself maintains the reservation of state-level lotteries in favor of the State Society of Lotteries and Betting —SELAE— and the National Organization of Spanish Blind People —ONCE—. Therefore, it is not an activity open to any company through an ordinary license.

A distinction must be made between the operator and the product: SELAE marketing a game does not mean it is legally a lottery. This difference also matters fiscally: article 48 excludes state lotteries from the gaming activities tax but does not automatically exclude other games organized by those operators.

As specific management regulations, there is the Resolution of November 27, 2001, which develops aspects of state-owned games, with a subsequent correction. The particular product rules must be examined together with the general framework.

3. Regulatory development

• Royal Decree 1614/2011, of November 14: develops licenses, authorizations, and gaming registers. It includes the authorization procedure for lottery commercialization, operator guarantees, contracts, gaming accounts, deposits, and prize payments. 4. Advertising, protection, and competent authority

Royal Decree 958/2020, of November 3, develops commercial communications of gaming activities. Law 23/2022 strengthened social responsibility in advertising, participant protection, and fraud prevention in sports betting.

The Directorate General for Gaming Regulation exercises state functions of regulation and supervision, according to the reorganization established by Law 3/2013. Autonomous communities retain their competencies over games within their scope; additionally, premises or in-person equipment require regional authorization when their legislation demands it. A state license does not replace that authorization.
