The Council of Ministers has dismissed the incompetence claims made by the communities of Andalucía and Extremadura regarding the State Housing Plan 2026-2030.

Both regional governments argued that the content of Royal Decree 326/2026, of April 22, which regulates the State Housing Plan, violated the distribution of competences, especially due to the financing model provided. In the case of Extremadura, the sections related to areas of tense residential market were also questioned.

However, the Council of Ministers responded this Tuesday to the two regional governments defending that the Plan "does not generally regulate the regional housing policy," but rather limits itself to articulating the state financing instrument, according to the references released this Tuesday.

In this context, the central Executive has brought up the ruling of the Constitutional Court which, on July 9, dismissed the appeal promoted by the Generalitat of Catalunya, in which the provisions of the law related to housing subsidies were specifically challenged.

The Government emphasizes that "the ruling rejects that the challenged provisions deprive the communities of decision-making capacity" and defends that the state legislator "has the competences to define the purposes and priority objectives of state financing."

"This does not prevent the communities from establishing their own objectives and priorities when configuring their housing policies," added the Executive, which also emphasizes that the Constitutional ruling takes into account that the approval of state plans requires the participation of the autonomous communities through the Sectoral Conference on Housing and Land.
