The first processed for the dissemination of the hoax of the 'Bar España case' who gives testimony in the trial being held in Plaza 3 of the Criminal Section of the Court of First Instance of Castellón, who is defending himself as he is a lawyer, stated this Tuesday via videoconference, in response to one of the accusations, that he never accepted as true anything that was reported and that his only intention was for an investigation to be carried out.
In this regard, he maintains that there was an "absolute absence" of actions on the part of the Prosecutor's Office and the other authorities with competence in the matter. "I only limited myself to making a professional action to request the investigation and to reach the conclusion of who was a victim and who was not," he indicated.
The accused referred to the commission he received in 2016 from a now-deceased person, whom the prosecutor places as the origin of the hoax, to appear in the courts. He explained that, based on the complaints that this person handed to him in writing, he prepared a report with the aim of analyzing the facts and clarifying whether they were true or not.
According to his version, that documentation described facts that pointed to the existence of a pedophilia network, with 13 alleged murders, two of them of minors, and he emphasized that in his report he urged the competent authorities to investigate the complaints made.
"I put on the table facts that have not been investigated, so now the report I prepared remains in vain," the processed emphasized.
Interrogated by the prosecutor, he admitted that the report he prepared in 2016 and another subsequent one were sent to various institutions, including the Royal House, the Anti-Corruption Prosecutor's Office, the Valencian Generalitat, the General Council of the Judiciary, the Prosecutor's Office, and the UCO, as well as to political leaders such as Pedro Sánchez or Mariano Rajoy, with the aim that the reported facts "would not happen again." When asked if he ever verified whether what was reported had actually occurred, he replied that he could not do so "due to lack of financial means."
He also stated that the documentation he relied on to draft his report had a "very large" appearance of verisimilitude. "I was very impressed by what I read and that is why I urged the competent bodies to collaborate in the investigation," he noted.
Before the statement of the accused, the prosecutor has requested that several links on social networks be considered as evidence, in relation to the request for prescription of the crimes raised by the defenses and with the eventual remorse of the accused, in which publications about the hoax of the 'Bar España case' continue to appear. The judge has rejected this request, understanding that it is not possible to attribute the authorship of the videos that appear in those links to the accused.
On the other hand, the magistrate has also dismissed the request made by the defenses last Friday, in which they questioned the active legitimacy of the Prosecutor's Office to act in the crimes of defamation and slander between individuals.
In this case, the Public Prosecutor's Office maintains the accusation against six people for the dissemination of the hoax of the so-called 'Bar España case', through which, at least since 1998, false implications of authorities and officials from different institutions in a pedophilia organization based in a bar in Benicarló would have been attributed. In addition, the editor of a digital medium will sit in the dock as civilly responsible.
