Judge Arturo Zamarriego has agreed to archive the investigation opened as a result of the complaint filed by Íñigo Errejón against Elisa Mouliaá for alleged defamation, according to the newspaper El País. The magistrate concludes that the actress's public statements about two witnesses in the case of alleged sexual assault do not allow for the crime reported by the former deputy to be appreciated.
The resolution, signed this Wednesday, puts an end to one of the cases arising from the judicial confrontation between the two. Errejón went to the courts after Mouliaá publicly accused him of having manipulated two witnesses related to the party where the actress claims she suffered a sexual assault.
The instructor now considers that the words that motivated the complaint do not contain the accusation of specific criminal acts necessary to sustain the defamation charge.
The complaint originated from accusations about two witnesses
The archived procedure has its origin in several messages published by Mouliaá on social media after two former friends of hers declared who were present at the house where the 2021 party was held.
Both appeared via videoconference from Australia and assured the judge that they had not observed "anything strange" that night. After their testimonies, Mouliaá publicly accused Errejón of having manipulated the witnesses.
Errejón considered that those statements were defamatory and went to the courts. Zamarriego himself initially admitted the complaint understanding that the facts presented characteristics that could point to the existence of a crime and summoned both to testify.
The investigation, however, now ends with a different conclusion once the proceedings have been carried out: the magistrate does not appreciate that Mouliaá attributed to Errejón specific criminal acts or conduct.
A case that led to a detention order against Mouliaá
The processing of this complaint went through several episodes over the last few months. Mouliaá did not appear on different occasions before the court citing, among other reasons, health problems and later work commitments abroad.
After his third absence, last June, Zamarriego ordered his detention and placement at the judicial disposition so that he could testify as an investigated party. The magistrate also agreed to deduce testimony given the possibility that the repeated absences could constitute a crime of serious disobedience.
Mouliaá subsequently returned to Spain and appeared before the judge.
The case for the alleged sexual assault is a different procedure
The filing agreed upon this Wednesday affects exclusively the lawsuit for defamation filed by Errejón against Mouliaá. It should not be confused with the judicial procedure opened as a result of the actress's complaint against the former deputy for an alleged sexual assault.
These are different cases, although the now-archived lawsuit arose from statements related to witnesses in the sexual assault procedure.
