A popular jury of the Provincial Court of Madrid has considered the two defendants guilty of the beating death of a man in Alcobendas on May 3, 2024, according to legal sources have indicated.
In a public session, the jury court read the verdict, in which it considers proven the involvement of both accused in the assault that ended the life of L.G., who died after receiving a violent beating on avenida del doctor Severo Ochoa in Alcobendas.
The representative of the Public Prosecutor's Office maintained the legal classification of the facts as the crime of murder, although on the last day of the trial she modified her request for sentence, reducing it from 18 to 16 years in prison, on considering that the consumption of alcohol impaired the volitional capacities of the two defendants.
The trial was left last week ready for judgment after the closing arguments of the prosecution and the defense. In her summation, the prosecutor relied on the statement of an eyewitness and on the reports of the forensic doctors to maintain that the numerous injuries suffered by the victim were of such magnitude that they would have caused the death of any person.
The deceased died as a consequence of a traumatic rupture of the spleen that caused a hemorrhagic hypovolemic shock. After the assault, the defendants left the area leaving the man completely naked, except for his socks, lying in the public street.
One of the accused denied in his statement having participated in the beating and pointed to the other as responsible. In his case, the Police did not find biological remains of the victim on his body, while on the other defendant's body blood was detected on the sneakers and on the hands. Before dying, the assaulted man himself had identified those who attacked him.
In broad daylight
The events took place around 13:17 on May 3, 2024, when both accused approached the victim, whom they knew, and got into an argument. One of them, O. A. P., grabbed him by the arm and, after adopting an aggressive attitude, dealt him a strong slap that made him collapse to the ground.
From that moment on, the two of them dealt him multiple blows and kicks to the head and the side, despite the fact that he could no longer defend himself, and left him naked on the ground before leaving the place. Officers of the National Police, alerted by several witnesses, arrested the defendants a few meters from the point of the assault.
During the oral hearing, the court listened to the recording of a call from a passerby to emergency service 112, in which he warned that "three people were beating each other up" and requested that the Police be notified.
After being detained, the two accused tried to justify the beating by alleging that the victim had stolen a mobile phone from them the night before. However, the deceased’s mother denied this version and stated that her son had spent that night with her.
The Prosecutor’s Office initially requested 18 years in prison for each of the accused for the crime of murder, as well as the payment of compensation of 190,000 euros to the deceased’s relatives. Upon considering the mitigating factor of alcoholic intoxication, it has now reduced its request to 16 years in prison for each defendant.
