The Supreme Court has ratified a sentence of 18 years in prison for a man for two crimes of sexual assault committed against a minor in Melilla, when the victim was eleven years old and the accused was 47. The high court has rejected the appeal for cassation from the convicted person and maintains the sentences of nine years in prison for each of the crimes.

According to the ruling accessed by Europa Press, the events took place in 2017, when the accused had a close relationship with the minor, daughter of a person in his circle, and had gained her trust through the friendship that his own children maintained with her. According to the proven facts recorded in the judicial resolutions, the man took advantage of that trust to carry out the sexual assaults.

The Provincial Court of Málaga, through its section based in Melilla, initially imposed a sentence of 23 years in prison for two crimes of sexual assault and one of injuries, in addition to other accessory penalties and indemnity obligations.

However, the Superior Court of Justice of Andalusia (TSJA), in a resolution dated November 21, 2025, partially upheld the appeal of the convicted person. The judicial body acquitted him of the crime of injuries and set the corresponding penalty for each of the two sexual assaults at nine years in prison, confirming the rest of the rulings of the sentence that were not modified.

Now, the Supreme Court has dismissed the cassation appeal filed against that decision, so the sentence of 18 years in prison remains firm. In addition, it imposes on the appellant, who is currently 56 years old, the payment of the costs of the proceedings before the high court.

TWO ASSAULTS TAKING ADVANTAGE OF THE RELATIONSHIP OF TRUST

According to the proven facts, the first episode occurred in the summer of 2017, when the accused invited the girl to spend the night at his house in preparation for a trip he planned to make with his children to Norway, to which he had also invited the minor. When the girl was already in bed, the man returned to the bedroom and sexually assaulted her, as detailed in the ruling.

The second episode took place in March 2020, when the minor, who was then 14 years old, went again to the home of the accused. On this occasion, the man offered her a massage after the girl stated that she had a headache and, taking advantage of that circumstance, sexually assaulted her again.

The judicial resolution indicates that, after this last incident, the minor showed significant changes in her behavior, with irritability, distrust, and fear of encountering people from the convicted person's environment. She also required psychological and psychiatric treatment for the consequences derived from the events.

RESTRAINING ORDER, DISQUALIFICATION, AND COMPENSATION

The ruling of the Provincial Court, whose other pronouncements were confirmed by the TSJA, imposed the prohibition of the convicted person approaching less than 500 meters from the victim, her home, her workplace, or any other place she frequented, as well as the prohibition of communicating with her for 20 years.

Likewise, he was imposed a special disqualification to exercise professions, trades, or activities that involve regular and direct contact with minors for 30 years, along with other accessory penalties and a measure of supervised release.

In the economic sphere, the initial resolution set compensation of 10,890 euros for the injuries and 40,000 euros for the moral damages caused to the victim.

With the decision of the Supreme Court, which rejects the last appeal filed by the convicted person, the sentence of 18 years in prison for the two sexual assaults committed against the minor is definitively confirmed.
