The Socialist Group has presented in the Andalusian Parliament a non-legislative proposal (PNL) before the commission of Presidency, Health, and Emergencies to demand the "recognition, in the employment pool of the Andalusian Health Service, of the services provided in residences for the elderly and socio-health centers during the Covid-19 pandemic."
The initiative, registered last Monday, September 14, and consulted by Europa Press, warns that "the provisional lists corresponding to the first cut of the new Employment Pool" of the SAS, "published in July 2026, have caused deep concern among thousands of professionals upon realizing that the experience acquired in elderly residences and socio-health centers during the pandemic has not been valued or has been excluded from the scoring in numerous files."
For this reason, the PSOE-A proposes that the Parliament urge the Andalusian Executive to "guarantee that the services provided in residences for the elderly and socio-health centers where health care activities were carried out during the exceptional periods recognized due to the Covid-19 pandemic are incorporated and valued, in all affected categories and professional specialties, according to the criteria established in the Resolution of November 10, 2020, of the General Directorate of Personnel of the Andalusian Health Service and in the other agreements and resolutions issued during the health emergency."
Likewise, the PNL demands that the regional Chamber ask the Junta to "review ex officio, before the publication of the definitive lists, the applications and files of the candidates included in the provisional lists of the first cut of the new Temporary Employment Pool" of the SAS "in which such professional experience has not been incorporated, has been valued with a score lower than the appropriate one, or has been excluded as a result of incorrect identification or classification of the workplace, proceeding to rectify the corresponding scores."
To this end, the socialist proposal contemplates that "express instructions be issued to the Central Unit of the Single Pool and to all the Evaluation Committees to ensure a uniform application of the scoring criteria."
Justification of the initiative
In the statement of reasons, the Socialist Group emphasizes that "the residences for the elderly and the socio-health centers played an essential role" in the health crisis of Covid-19, and recalls that the Andalusian Government "adopted, within the framework of managing the health emergency, exceptional measures by which the socio-health centers with health care were functionally integrated into the public health response to Covid-19, recognizing the essential nature of the activity carried out by their professionals."
The PNL details that the resolution of November 10, 2020, from the General Directorate of Personnel of the SAS, "by which extraordinary measures applicable to the Temporary Employment Pool of the SAS during the pandemic were approved, expressly established that the residences for the elderly and the socio-health centers where health care was provided would be considered public health centers, also providing for a reinforced assessment of the services rendered during that exceptional period."
In the same vein, it is recalled that "in the same sense, the Agency for Social Services and Dependency of Andalusia approved on April 23, 2020, a specific measure recognizing the professional experience acquired by the staff who provided services during the state of alarm, a criterion that has subsequently been incorporated into the public employment calls of the Agency itself through the double assessment of that professional experience."
In this way, the PSOE-A emphasizes that "the Andalusian Administration itself generated a uniform administrative criterion according to which the professional experience acquired in those centers should receive the same recognition as that provided in public health centers."
However, after the publication in July 2026 of "the provisional lists corresponding to the first cut of the new Employment Pool" of the SAS, it is noted that "the experience acquired in residences for the elderly and socio-health centers during the pandemic has not been valued or has been excluded from the scoring in numerous files," according to the socialist text.
For the PSOE-A, the "exclusion now of those services, without an express repeal of the previous resolutions, without sufficient motivation and without an objective justification that explains the change of administrative criterion, seriously compromises the principles of legal certainty and legitimate trust."
Furthermore, the Socialist Group points out that "the administrative action may be contrary to Article 14 of the Spanish Constitution, by establishing unequal treatment regarding professionals who performed comparable assistance functions during the same health emergency, that there is an objective and proportionate cause that justifies such a difference in treatment."
Risk of "situations of inequality"
The initiative also warns that "the sudden alteration of the criteria for assessing a professional experience that the Administration itself had expressly recognized during the pandemic directly affects the principle of merit and can provoke situations of inequality among candidates who performed equivalent assistance functions."
Likewise, the PSOE-A considers that "it is particularly paradoxical that those who were classified by the Administration itself as essential professionals during the pandemic, and whose work was the subject of an express administrative recognition, now see that consideration disappear precisely in the procedures for access to public employment called by that same Administration."
In conclusion, the Socialist Group maintains that "the institutional recognition to those who sustained healthcare during the pandemic (...) must translate into full respect for the rights that the Junta de Andalucía itself recognized for them and in the fulfillment of the commitments made during the greatest health emergency in our recent history," and demands "to urge the Council of Government to restore legality, equal treatment, and legal certainty in the scoring procedures of the Employment Pool of the Andalusian Health Service."
