A magistrate from Madrid has decided not to admit the lawsuit filed by Vox against the Secretary General for Innovation and Quality of the Public Justice Service, Sofía Puente, for alleged crimes of prevarication and usurpation of functions linked to the so-called 'grandchildren's law'. This decision comes after another court accepted to investigate the same high-ranking official following a complaint from Hazte Oír for analogous facts.

As "Eldiario.es" reported and legal sources have confirmed to Europa Press, the head of the Court of Instruction No. 3 has chosen to dismiss the lawsuit promoted by the party led by Santiago Abascal.

The complaint from Vox, registered last July, referred to actions from October 2022, when Puente —sister of the Minister of Transport, Óscar Puente— was serving as the Director General of Legal Security and Public Faith, according to sources from the party.

At that time, "she signed the instruction that allowed the nationalization of descendants of Spanish emigrants, just a few days after the approval of the Democratic Memory Law," Vox claims.

For the party, "this instruction was signed with Puente's knowledge that it was illegal, which entails the crime of prevarication," and they also noted signs of a possible usurpation of functions "for issuing a provision of general scope that innovates the legal system and creates a modality of acquiring nationality outside the Civil Code."

Meanwhile, this Wednesday it was revealed that another magistrate, responsible for the Court of Instruction No. 35 of Plaza de Castilla, has decided to admit the lawsuit filed by the association Hazte Oír against Puente for an alleged crime of administrative prevarication related to the so-called 'grandchildren's law', that is, the provision of the Democratic Memory Law that grants nationality to descendants of exiles.

In that lawsuit, which Europa Press also had access to, Hazte Oír accuses Puente of having issued an "instruction" that "exceeded" the scope of the 'grandchildren's law' after the accused herself committed "to the strict application of the law." The Prosecutor's Office, on the other hand, expressed its support for the filing of the case.

The association also denounced that "the exclusion of the minister of the branch and the personal connection of the accused with the minister who had drafted the law indicate the channel through which the indication of the change of criteria could have been transmitted" and emphasized that "the subsequent promotion of the accused, agreed precisely by --the minister of the Presidency, Justice and Relations with the Courts-- Félix Bolaños upon assuming the Justice portfolio, is an objective fact whose eventual correspondence with the events must be clarified by the investigation".
