The Constitutional Court has already sent to the Supreme Court the ruling in which it urges it to apply amnesty to the crime of embezzlement that weighs on several leaders of the 'procés', including the former Catalan president who fled justice and leader of Junts, Carles Puigdemont.
Sources from the court of guarantees indicate that both the resolution and the dissenting opinion signed by the five dissenting magistrates have already been communicated to the Supreme Court and the rest of the parties involved.
In the Plenary held this Tuesday, the majority of progressive sensitivity supported the text drafted by the president of the Constitutional Court, Cándido Conde-Pumpido, which was favorable to amnesty for the former ERC councilor Dolors Bassa for the embezzlement for which she was convicted by the Supreme Court, which until now had refused to apply criminal pardon to that crime.
For the same crime, former vice president Oriol Junqueras and former councilors Raül Romeva and Jordi Turull, current secretary general of Junts, were sentenced and now hope that the Supreme Court will extend the amnesty to them, while in a procedural situation identical to that of Puigdemont, as defendants but not tried for having fled justice, are the former councilors Toni Comín and Lluís Puig.
In its ruling, the court of guarantees declares the nullity of the appealed orders that rejected the application of amnesty and orders to revert the proceedings to the moment immediately prior to the issuance of the first of them, with the aim that the Criminal Chamber of the Supreme Court, the same one that judged the case, issues a new resolution in which the crime of embezzlement of public funds for which Bassa was convicted is declared amnestied, as indicated by the TC itself in an informative note.
