The Plataforma de Afectados por la Corrupción en Canet —formerly called Plataforma de Afectados por las Actividades ilícitas y delictivas de José Antonio Sancho Sempere— has called on the Government delegate in the Comunitat, Pilar Bernabé, to offer public explanations about her actions in the face of the alleged irregularities in the promotion of José Rodríguez Jurado to the A1 subgroup, as well as about the fact of having kept him at the head of the Subdelegación del Gobierno in Valencia after, according to the entity, those facts were expressly conveyed to her.
According to what the platform explained in a statement, a burofax was sent to the Delegación del Gobierno in which the objections to the internal promotion procedure were set out and an institutional intervention was requested to clarify what had happened. However, it denounces that it has not been informed of what checks were carried out, what reports were obtained, or what decisions were adopted after that warning.
The case focuses on Rodríguez Jurado’s internal promotion process in the Ayuntamiento de Canet d'en Berenguer, through which he went from the C1 subgroup to A1 before being appointed subdelegate. The Fiscalía Anticorrupción filed a complaint over the possible irregularities detected in said procedure.
After this complaint, the number 2 court of the Civil and Investigating Section of the Tribunal de Instancia de Sagunt agreed to open preliminary proceedings to handle the matter.
The platform maintains that knowledge of a specific complaint related to a public employment access process "required a motivated institutional response, especially because it affected the person who held the Subdelegación del Gobierno". It emphasizes that it does not intend to replace the courts or anticipate their conclusions, but rather to clarify another aspect: what the head of the Delegación did when she received the communication from those affected and what arguments supported maintaining her confidence in Rodríguez Jurado.
In its view, the presumption of innocence must be fully respected, "but it cannot be used as a generic response to avoid questions about the checks carried out, the management of the warnings received, or the criteria applied to keep a person in a position of public responsibility".
For this reason, the entity requests that the moment when the Delegation became aware of the alleged irregularities and the treatment given to the platform's communications be made public; as well as the legal reports that were requested or consulted regarding the promotion to subgroup A1 and its fit with the requirements for appointment as deputy delegate.
Likewise, it asks about the actions taken, where appropriate, before the Ayuntamiento de Canet d'en Berenguer or other competent bodies; the reasons why Rodríguez Jurado was kept in office after receiving the warnings; and the response offered to those affected, as well as the reasons why, according to the platform's complaint, they have not obtained an explanation.
The entity has also asked that the resolutions on which the Delegation might rely to uphold the regularity of the promotion procedure be detailed and interpreted.
