Vox has formalized a complaint before the Supreme Court against the Minister of Transport and Sustainable Mobility, Óscar Puente, to whom it attributes alleged crimes of negligent homicide by gross negligence and injuries arising from the railway accident recorded this Wednesday in Urda (Toledo).
In a filing accessed by Europa Press, the party led by Santiago Abascal specifies that the criminal action is directed against the minister "for the failure to comply with his own duties of direction and control in relation to railway safety and the supervision of the entities attached, in the terms specified in the following facts and grounds".
The party also clarifies that "objective liability is not attributed to him because of the office or because of the acts of his subordinates, but rather the omission of his personal duties of guarantee, with reservation of expansion against those who prove responsible". In Vox's view, it is the high court that must hear the case due to Puente's status as a protected official, and not the court of Orgaz (Toledo), which is investigating the accident.
"Omission of a supervision response"
According to Vox, the complaint "is directed at the omission of an effective supervisory response, aimed at reviewing the mechanisms for risk detection and control, the real application of safety procedures and the implementation and follow-up of corrective measures after accidents of extraordinary seriousness and the repeated warnings that followed".
The complaint emphasizes that the action demanded of the head of Transport "consisted of activating, through the competent bodies, the obtaining of sufficient technical information; demanding a documented evaluation of the deficiencies relevant to safety; promoting the appropriate controls, inspections or audits; requiring corrective plans with responsible parties and deadlines; and verifying that the agreed measures were effectively carried out".
For all these reasons, Vox asks the Supreme Court to admit the complaint against Puente for the alleged crimes of negligent homicide and injuries, summon him to testify as a person under investigation, take testimony from various witnesses and appoint "independent experts specializing in traffic" so that they present their "technical conclusions".
