What is the parliamentary process that a Royal Decree must follow after its public consultation period ends?

An ordinary royal decree does not have to follow a parliamentary process after the public consultation. Its drafting continues within the Government and the Administration, until its eventual approval by the Council of Ministers and publication in the Official State Gazette (BOE). Therefore, it does not go through the Congress and the Senate to receive amendments or be approved as a law.

The important distinction is between royal decree, royal decree-law, and bill: they are different instruments and do not have the same path. If you refer to a draft royal decree submitted to public consultation, the general itinerary is as follows.

1. Examination of the contributions received

Once the consultation period is closed, the responsible ministry examines the allegations from citizens, companies, associations, and other participants. It may introduce modifications, maintain the proposed wording, or reconsider certain measures. The consultation is not a vote and the contributions received do not oblige accepting every requested change.

The result must be reflected in the procedure documentation, explaining the participation carried out and the assessment of the observations. The closing of the consultation alone does not mean that there is a definitive text nor that its approval is immediate.

2. Review of the text and its justification

The promoting department reviews the draft and updates the report explaining its necessity, objectives, and effects. Depending on the subject, this justification includes economic, budgetary, administrative issues, and other relevant impacts.

It must also verify that the content respects the law it develops and the corresponding competencies. A royal decree is a regulatory norm: it cannot modify by itself what a law has established without an enabling provision that allows it.

3. Relevant reports and opinions

The drafting incorporates the legal, technical, and affected bodies' reports that are required. Not all royal decrees need exactly the same reports: it depends on their content and the rules applicable to the procedure.

When appropriate, an opinion must be requested from the Council of State. The observations received may motivate new corrections. Also, these tasks do not always occur strictly linearly: some reports may have been requested before or during the consultation and others afterward.

4. Submission to the Council of Ministers

Once preparation is complete, the promoting ministry submits the text for examination and eventual approval by the Council of Ministers, with the corresponding governmental coordination. The Government may approve it, postpone it, or request modifications.

There is no intermediate ordinary parliamentary approval. Nor is a period for amendments to the draft royal decree opened in Congress as would happen with a bill.

5. Publication and application

Once approved and formalized, the royal decree is published in the BOE. Its application begins according to the corresponding effective date. It is advisable to also review its transitional provisions: they may establish progressive adaptations or different deadlines for certain obligations.

What role does Parliament retain?

The Cortes can control the Government's actions through questions, appearances, interpellations, motions, or requests for documentation. This control does not equate to approving the royal decree. Different is the royal decree-law, which does require a decision by Congress on its maintenance or repeal. In summary: after the public consultation of an ordinary royal decree, you must follow its administrative drafting and governmental approval, not a parliamentary legislative process.

What competencies does the Ministry of Inclusion, Social Security and Migrations have regarding the collective management of origin hiring?

The Ministry of Inclusion, Social Security and Migrations has competencies in planning, regulation, coordination, and monitoring of the collective management of origin hiring (GECCO). It also intervenes in the evaluation of offers and in the authorization and supervision of selection processes in the countries of origin. However, it does not concentrate all decisions: residence and work authorizations and visas require the intervention of other bodies.

1. Annual planning and regulation

Article 115 of the Foreigners Regulation, approved by Royal Decree 1155/2024, establishes that the head of the Ministry, taking into account the national employment situation, may annually approve "a forecast of occupations and, where appropriate, the number of job positions" covered through GECCO.

This forecast is approved by ministerial order and may cover stable and seasonal hiring. It also allows establishing a number of job search visas for children or grandchildren of Spaniards by origin or for certain occupations and territories. The number and distribution of offers may be revised during the year; additionally, the Ministry may extend the uncovered figure, after consulting the Tripartite Labor Immigration Commission.

For 2026, the annual development is set out in Order ISM/1547/2025, of December 23, published on December 30, 2025.

2. Preparation of the proposal and territorial participation

The Secretary of State for Migrations prepares the annual proposal. It must consider information from the State Public Employment Service and proposals from autonomous communities, formulated after consulting representative trade union and business organizations.

The proposal is submitted for consultation to the Tripartite Labor Immigration Commission and presented to the Interministerial Foreigners Commission for an opinion on the appropriateness of approving the order. Therefore, the ministerial planning incorporates labor information, territorial participation, and consultation with social agents.

3. Management of offers and selection in origin

Article 6 of Royal Decree 501/2024 expressly assigns the General Directorate of Migratory Management the ordering of GECCO, selection and hiring processes in origin, support to selected persons, and monitoring of hiring.

Article 122 of the Regulation specifies its powers:

  • Evaluate files favorably reported by the territorial body and promote preselection and selection.
  • Authorize the selection process once its conditions are set, in cooperation with authorities of the country of origin.
  • Participate or supervise the selection, which must be free and respect equitable hiring rules.
  • Reasonably agree to its termination if those rules are breached.
  • Report quarterly to the Tripartite Labor Commission on the processes carried out.
4. Coordination, guarantees, and limits

The Ministry functionally coordinates foreign offices and peripheral bodies, and coordinates with autonomous communities with competencies in work authorizations. Likewise, it promotes cooperation with countries of origin and channels offers through the Spanish diplomatic representation, as explained in this official explanation of the procedure.

Its monitoring function includes hiring and system guarantees. The 2026 order requires, for example, accommodation during the entire circular migration activity and communication of its changes.

The practical distinction is important: applications are processed territorially; the competent Government Delegation or Subdelegation resolves authorizations in the generic offers procedure; consular offices process visas, and the Interior Ministry intervenes in police checks and assignment of foreigner identity numbers.

What are the legal requirements to participate in a public consultation on regulatory projects in Spain?

In Spain, participation in public consultations on future regulations is generally open to interested individuals, organizations, and entities. To participate, the essential thing is to pay attention to the official announcement: identify the procedure, send contributions through the enabled channel, and respect its deadline and conditions. The requirements of a specific call should not be confused with obligations applicable to all consultations.

1. Distinguish the participation phase

The general reference framework is Law 39/2015, on the Common Administrative Procedure of Public Administrations, along with the regulations applicable to the convening Administration. There are two moments to differentiate:

  • Prior public consultation: held before drafting the text. It allows opinions on the problems to be solved, the need to intervene, objectives, and possible alternatives.
  • Hearing and public information: developed when a draft already exists. Observations may refer to its content and propose specific changes in its provisions.

This difference determines what documentation will be available and what type of contribution is pertinent: a general proposal about future regulation or an observation on an already drafted text.

2. Who can participate

Participation is not limited to companies, professional associations, or specialists. An individual may also intervene personally. Organizations and entities can provide their perspective on the regulation's effects on their activities or the groups they represent.

However, an open consultation to the public should not automatically be equated with a hearing directed at affected subjects. It is advisable to check who the announcement's recipients are and if there are specific instructions to participate on behalf of an entity.

3. Conditions to check
  • Deadline: the published closing date must be reviewed. The deadline of another consultation should not be transferred, even if it deals with a similar subject.
  • Submission channel: contributions must be sent through the channel indicated by the convening body. Publishing an opinion on social networks does not equate to submitting it in the procedure.
  • Identification: it is necessary to check what data the form or announcement requests. The consulted information does not allow affirming that there is an identical requirement for ID, electronic signature, or identification for all consultations.
  • Representation: if acting on behalf of an organization, it must be clear in what capacity participation occurs and follow the corresponding instructions.
  • Format and documentation: indications about forms, documents, and submission methods accompanying the procedure must be respected.
4. Content of contributions

In a prior consultation, it is appropriate to explain the problem, provide information on its effects, and propose solutions or alternatives. In a hearing on a draft, it is useful to identify the provision commented on, explain the objection, and propose alternative wording.

These are practical clarity recommendations, not universal legal requirements. Nor should hiring legal advice or submitting a technical report be considered mandatory when the call does not require it.

5. Competent administration and personal data

Specific conditions may vary between the state Administration and autonomous administrations, which have their own transparency and participation rules. Therefore, the announcement from the ministry, council, or responsible body is the immediate reference to prepare the submission.

Before submitting documentation, also review information on data protection and possible dissemination of contributions. Participation should not be assumed to guarantee anonymity or confidentiality. In short, check recipients, deadline, channel, identification, and format before sending your proposal.
