The Official Bulletin of the Parliament of Andalusia disseminated this Friday, October 30, 2026, the resolution signed by the president of the regional chamber, Ana Mestre (PP-A), by which "the cessation as councillor of the Chamber of Accounts" of Andalusia of Antonio Manuel López Hernández is declared.

That agreement, to which Europa Press has had access, appears in the BOPA dated this Friday, although it is dated last October 13. It is issued a few days after, on October 9, the "communication" of the president of the Chamber of Accounts, Manuel Alejandro Cardenete, was registered in the Andalusian Parliament, by which he conveyed to the Presidency of Parliament the dismissal of the councillor agreed by the Plenary of the auditing body.

According to the published resolution, from the letter sent by the president of the Chamber of Accounts, it was on October 9 itself when the Plenary of the auditing body, "after examining the actions carried out during the investigation of the corresponding case, had agreed to declare" that Antonio Manuel López Hernández had "incurred in supervening incompatibility for the office of councillor of the Chamber of Accounts of Andalusia".

"In accordance with what is provided for in the aforementioned agreement, and by virtue of what is stipulated in article 27 of Law 1/1988, of March 17, of the Chamber of Accounts of Andalusia", the president of Parliament, Ana Mestre, records in the resolution disseminated in the chamber bulletin the "cessation" of Antonio López "in the office of councillor of the Chamber of Accounts of Andalusia, with effect from the date hereof".

Incompatibilities noted by the Plenary

The Plenary of the Chamber of Accounts promoted this dismissal after "declaring" that various activities carried out by Antonio López "determine the concurrence of six differentiated situations of incompatibility, in accordance with what is provided for in article 26 of Law 1/1988, of March 17, and in article 35" of the regulations governing the organization and operation of the auditing body.

"In particular", the agreement of the Plenary of the Chamber of Accounts that gave rise to the procedure focused on the "teaching activity" carried out by Antonio López at the University of Granada, which, "although susceptible to authorization in the terms provided for in article 35.2 of the Regulations, was carried out without the prior authorization of the Plenary required by said provision".

Thus, the Plenary of the institution identified a set of activities carried out by the now former councilor that "determine the concurrence of six differentiated situations of incompatibility", according to the body’s agreement, where it was specified that "each of them presents sufficient autonomy to constitute the legal ground for removal".

Consequently, upon verifying the "concurrence" of "six situations of incompatibility", the Plenary of the Chamber of Accounts resolved that it was appropriate to "declare the existence of the corresponding legal grounds for removal" of Antonio López, "in accordance with article 27 of Law 1/1988, of March 17, in relation to articles 24.1.d) and 37" of the institution’s internal regulations.

PSOE-A appeal and Antonio López's response

After the resolution of the president of the Parliament was made public, the Socialist Group —which had proposed Antonio López for the post of councilor— filed a written statement in which it expressed its "express opposition" to the content of the same, and in which it asked that it be left "without effect, considering it contrary to Law", alleging "reasons of competence, procedure and guarantees".

At the same time, Antonio López himself expressed in a note sent to Europa Press his "most absolute rejection of a decision that, from a legal point of view, could constitute an action of extraordinary gravity, contrary to the legal guarantees that protect the independence of the members of this institution", recalling that he had been "elected councilor by a qualified majority of the Parliament of Andalucía", and "removed by the decision of a single person, its president, without the Plenary of the Parliament having even been able to rule".

In that same line, Antonio López announced that he would initiate "the appropriate judicial actions before the Contentious-Administrative Chamber of the Superior Court of Justice of Andalucía (TSJA), requesting the protection" of his "rights and the review of the decisions adopted, including, where appropriate, the adoption of the precautionary measures that are appropriate".
