The Provincial Court of Badajoz considers it "implausible" that the then president of the Diputación pacense, Miguel Ángel Gallardo, "did not directly participate" in the creation of the position finally awarded to the brother of the President of the Government, David Sánchez Pérez-Castejón.

This is stated in the judicial resolution of the Provincial Court of Badajoz, which imposes an 18-year disqualification penalty on Miguel Ángel Gallardo for two crimes of administrative prevarication related to the creation of the position obtained by David Sánchez and the subsequent modification of it.

The sentence recalls that the Diputación de Badajoz was an institution of a "presidential character," where Gallardo, as the highest leader, had the authority to appoint and dismiss High Management personnel, a group that in this organization ranged from 10 to 19 positions.

For this reason, and given the "strong link" between high management personnel and political leaders, the court emphasizes that it was "generally known" in the Culture department that the position had been created to be occupied by David Sánchez, making it "implausible" that the president of the Diputación de Badajoz "did not know this circumstance and did not directly participate in the events."

The resolution adds that Gallardo "had a personal relationship" with David Sánchez, with whom he "held meetings, shared meals, and was directly informed by him of his projects," a circumstance that reinforces, in the court's opinion, his involvement in the entire process.

Furthermore, it is indicated that the then president received information about all personnel needs and about new positions that were to be created in the Diputación de Badajoz, even complaining on other occasions that "too much personnel" was requested. However, regarding the position that David Sánchez ended up occupying, he "directly inquired about the minimum deadlines for awarding a high management position" and replied "Great."

The court also highlights that, from the analysis of David Sánchez's emails, "it is derived that they had a close relationship and even spoke on weekends," and that Miguel Ángel Gallardo "was aware of the Ópera Joven project from its inception," as well as of the "change in nomenclature" of the position carried out in 2022, when it became known as head of the Performing Arts Office.

Consequently, the Provincial Court of Badajoz declares the former president of the Provincial Council "responsible as the perpetrator of the crimes of administrative prevarication," in relation to both the creation of the position of coordinator of activities for the conservatories and its subsequent transformation into head of the Office of Performing Arts.
