A popular jury begins this Monday to try a 41-year-old man for whom the Prosecutor's Office of Jaén requests permanent revisable imprisonment for the alleged murder of a 74-year-old woman in Sabiote (Jaén), in May 2024, when he allegedly accessed her home with the intention of stealing.
In addition, the Public Ministry requests 15 years in prison for the accused for a crime of sexual assault, another five years for a crime of robbery with violence in a inhabited house, and five more years for a crime of robbery of use of a motor vehicle with violence, applying in these last two types of offenses the aggravating factor of recidivism.
In the section of civil liability, the Prosecutor's Office is interested in compensating the four children of the victim with 250,000 euros for the damages caused.
According to the indictment from the Public Prosecutor's Office, reported by Europa Press, the accused, who has been in provisional detention since the events occurred, climbed the wall to reach the terrace of the woman's house, who was sleeping with the window open, a circumstance he took advantage of to enter the interior.
Once in the house, the accused went to the bedroom where the victim was resting. After delivering numerous blows, he stabbed her up to six times "with a sharp object he was carrying or some other similar instrument." He then also sexually assaulted her.
Finally, realizing that the woman "had identified him, knowing who he was and to avoid being reported by her," he strangled her. He then took a bottle of bleach and sprayed the room "with the aim of concealing the crime he had committed and leaving no clues for them to discover."
Before leaving the property, "driven by a desire to profit," he took various objects from the house, including money, a grill, jewelry, some handcuffs, and several jugs of oil.
Finally, he took the victim's car keys and left towards a brothel in Úbeda (Jaén), where he entered displaying three bottles of oil, a grill, the handcuffs, and several pieces of jewelry he had just stolen. That same day he was arrested and entered prison, a situation in which he remains awaiting the oral hearing.
This is the second occasion in which the Prosecutor's Office before the Court of Jaén requests the permanent revisable prison for a defendant. The Provincial Court already imposed this sentence in July 2024 on a 26-year-old man, who was declared guilty by a jury of the murder and rape of a 14-year-old girl whose body was found in February 2022 in the ruins of the Church of Santo Domingo, in Alcalá la Real (Jaén).
