The Provincial Court of Almería has imposed a sentence of three years in prison on a man who inflicted three stab wounds to another man's chest and thorax during a fight in which he witnessed how this man pushed and threw his father to the ground, causing him to break an ankle.
According to the sentence, consulted by Europa Press and already final, the main defendant has been convicted of attempted homicide, along with a prohibition on approaching and communicating with the victim for 14 years. In turn, the stabbed man is imposed a sentence of six months in prison and six years of distancing for the aggression against the parent of the person who attacked him with the knife.
The events date back to 2:00 a.m. on June 16, 2022, near a pub located in La Gangosa, in the municipality of Vícar (Almería). There, a dispute arose between a father and his son and another man, during which all three involved assaulted each other, although no injuries were recorded at that first moment.
During the altercation, the third accused delivered a "strong push" to the father, causing him to fall to the ground. As a direct consequence of that push and the fall, the man suffered an ankle fracture that required surgical intervention, with a healing time of 284 days and permanent sequelae.
Upon seeing what happened, the son took out a knife with a 14-centimeter blade that he was carrying and, "with the intention of ending his life," inflicted three stab wounds: one to the chest, another near the armpit, and a third to the arm.
The stab wounds caused a fracture of a rib affecting the musculature and the thoracic cavity, in addition to pneumothorax, pulmonary contusion, and other injuries that required urgent surgical intervention. The affected person took 120 days to heal, leaving him with a post-traumatic stress disorder as a sequela and, as an aesthetic detriment, three scars.
The court has considered it proven that the wounds caused —two of them incised— occurred in a "vital risk area" such as the thorax, where there is a high probability of causing pulmonary, cardiac, vascular, or tracheal injuries; so that, had he not received immediate medical attention, the man would have died.
The parties, who admitted the facts and their responsibility at the beginning of the oral hearing, had previously recorded the amounts set as civil liability to compensate for the damages caused.
