The Provincial Court of Salamanca has imposed a two-year prison sentence on a woman as the author of an offense of corruption of minors, after admitting that she took several photographs and a video of a sexual nature of her 11-year-old daughter and sent them through social networks.
In the ruling, it is considered proven that the material was sent via Instagram to an account that the defendant mistakenly thought belonged to the Portuguese footballer Cristiano Ronaldo.
According to the judgment to which Europa Press has had access, the woman took different images of the minor, in some of which she appeared naked or displaying her genitals, in addition to recording a video in which she could be seen without underwear.
Subsequently, she sent all that content from her own Instagram profile to an account that she believed belonged to the well-known player, although in reality it had been created by a friend of her daughter.
At the oral hearing held on 28 October of last year, the Public Prosecution Service, the private prosecution and the defense reached an agreement in accordance with proceedings on the basis of agreement. The defendant acknowledged the facts and it was recorded in the case that at the time of what occurred she suffered from a reactive anxiety-depressive syndrome and a diagnosis of borderline intellectual disability that affected her abilities, a circumstance that the court has assessed as a very qualified mitigating factor of a mental abnormality.
In addition to the prison sentence, the ruling establishes a restraining order that prevents her from approaching the minor by less than 250 meters and from communicating with her for a period longer by one year than the duration of the sentence.
The woman must also comply with three years of supervised release, follow sex education programs, remain disqualified for six years from exercising parental authority, and may not take up jobs or professional activities that involve habitual contact with minors.
As civil liability, the convicted woman will have to pay 17,000 euros to the minor as compensation for the moral damages caused.
The sentence is not final and an appeal may be lodged against it before the High Court of Justice of Castile and León.
