The Provincial Court of Girona has imposed a sentence of permanent revisable imprisonment on a man who, on July 26, 2023, sexually assaulted and murdered his 26-year-old ex-girlfriend in Girona.
The resolution, which Europa Press has accessed, reflects the verdict of the jury, which found him guilty of a crime of murder with premeditation, another of sexual assault, and a crime of robbery with violence.
The jury established that the accused accessed the building where the victim lived wearing a hood, gloves, and a mask to avoid being recognized, and waited for her on the landing. When the young woman returned from her workday, he "held her tightly," forced her into his apartment, and closed the door.
Once inside the home, he applied the 'mataleón' technique until he left her unconscious, tied her hands behind her back, and performed sexual touching. When the woman began to regain consciousness, he strangled her until he caused her death in order to avoid "being reported or identified."
After the crime, the convicted man searched the drawers of the home and the victim's bag and stole two bank cards.
Prison sentences and civil liability
In light of the facts, the presiding judge of the jury has sentenced him as the author of a crime of murder, appreciating the mitigating factor of confession and the aggravating factor of disguise, to permanent revisable imprisonment, in addition to absolute disqualification for the entire duration of the sentence.
For the crime of sexual assault, also with the aggravating factor of disguise, he has been sentenced to 9 years in prison. Regarding the robbery with violence, the sentence sets a penalty of 3 years in prison, applying the highly qualified mitigating factor of confession along with the aggravating factor of disguise.
Along with the prison sentences, the convicted man must pay compensation of 230,000 euros to the parents of the victim and 9,000 euros to her partner, as civil liability.
