The Madrid Prosecutor's Office has reduced from 18 to 16 years in prison the sentence it requests for each of the two defendants for the death by beating of a man in Alcobendas on May 3, 2024, upon appreciating the mitigating factor of alcohol intoxication due to the impairment of their volitional capacities resulting from alcohol consumption.
The trial against the two accused for the death of L. G. has been concluded for sentencing after the presentation of the final reports from all parties. The victim lost his life after receiving a violent beating on Doctor Severo Ochoa Avenue in Alcobendas. As a consequence of the assault, in which he suffered a ruptured spleen, the defendants left the man naked lying on the public road, dying a few minutes later.
The Public Prosecutor's Office also requests five years of supervised release for one of the defendants, David, who has been diagnosed with chronic alcohol abuse. The prosecutor has introduced this change in her final report, in which she has maintained the legal classification of the facts as a crime of murder.
However, she has reduced the penalty initially sought for both, considering that the alcohol intoxication influenced their volitional capacities, that is, their ability to behave according to their will.
In her presentation, the prosecutor referred to the statement of an eyewitness to the assault and to the reports of the forensic doctors to support that the numerous injuries were significant and would have been fatal to any person. "There is sufficient evidence to consider it proven that with their joint action they caused his death," emphasized the representative of the Public Prosecutor's Office.
Despite the fact that the deceased himself identified his attackers before dying, one of the accused denied before the court having participated in the beating and tried to blame the other. In his case, the Police did not find biological traces of the victim on his body, while in the case of the other defendant, blood was detected on his shoes and on his hands.
At the time the events occurred, several passersby reported the assault and observed how the perpetrators left the victim completely naked, only wearing socks.
During the practice of the documentary test, the court heard the call of a passerby to 112 in which he warned that "three people were fighting" and asked for the Police to be alerted to come immediately to the place.
In broad daylight
The events occurred around 1:17 PM on May 3, 2024, when the two accused approached the victim, whom they knew, and began a discussion. One of them, identified as O. A. P., grabbed him by the arm and, after a violent reaction, dealt him a strong slap that knocked him to the ground.
Immediately afterwards, both continued to assault him repeatedly with kicks to the head and side, despite the fact that he could no longer defend himself, and left the area leaving him naked on the pavement. Agents of the National Police, alerted by witnesses, arrested them a short distance from the place. The beating caused him a traumatic rupture of the spleen that led to hemorrhagic hypovolemic shock and, ultimately, to his death.
After being arrested, the two defendants tried to justify the assault by claiming that the victim had stolen a mobile phone from them the night before. However, the mother of the deceased categorically rejected this version and assured that her son had spent the night with her.
At first, the Prosecutor's Office requested 18 years in prison for each of the defendants for a crime of murder, in addition to compensation of 190,000 euros intended for the relatives of the deceased.
