The presiding magistrate of the Jury Court has decreed the internment in a psychiatric center for a period of 38 years for the man who ended the life of his mother and his brother in April 2024 in Manacor (Mallorca).

In the oral hearing, the accused admitted the facts and the parties involved in the case reached an agreement, so it was not necessary to constitute the popular Jury.

Nevertheless, five expert reports were carried out on the mental health status of the accused in order to specify what security measure was appropriate and for how long it should be applied.

According to what was recorded in the proceedings, the accused, after suffering a psychotic episode linked to substance use, struck his mother, 82 years old, until causing her death, dragged the lifeless body, and burned it. He then attacked his brother, who had a disability, and also took his life. Afterward, he caused a fire in the home and confronted the agents of the National Police Corps who came to arrest him.

The presiding magistrate of the Jury Court has issued a ruling in which he acquits the accused considering him exempt from criminal responsibility due to insanity, in application of article 20.1 of the Penal Code. The judge appreciates the complete exemption in relation to the crimes of murder, assault, and injuries.

"The disorder presented by the accused is a severe, chronic disorder with no possibility of cure," states the ruling. According to the magistrate, the accused "is susceptible to experiencing a new severe psychopathic episode."

The judge details that any minimal alteration, such as the simple intake of a coffee, a variation in his routines, or a specific event in daily life, can trigger a new decompensation.

"In a protected environment, the prognosis is positive regarding the disappearance of symptoms; in an open or free environment, the prognosis is totally negative and susceptible to generating extremely serious violent behaviors," argues the judge.

The ruling indicates that all specialists who participated in the joint expert report agreed that outpatient resources are insufficient for this case, "categorically ruling out such a possibility, and agreeing on the need for internment in a psychiatric center."

In terms of civil liability, the accused must pay compensation of 50,000 euros to his sister and a total of 2,520 euros to three agents of the National Police Corps who participated in his arrest.

The magistrate has ordered his provisional release until the sentence is final, given that an appeal can be filed against the resolution before the Civil and Criminal Chamber of the High Court of Justice of the Balearic Islands (TSJIB).
