The Prosecutor's Office and the Office of the State Attorney have requested this Friday that Koldo García, Víctor de Aldama, and the former president of Adif Isabel Pardo de Vera be put in the dock, among other people under investigation, in a new branch of the Koldo case that brings together alleged irregularities related to mask contracts, the payment of taxes, and the contracting of Ábalos's former partner in public companies.
The request also affects Joseba García, the former ministerial adviser’s brother, and Jessica García, Ábalos's former partner. The charges seek that acts that were left out of the procedure followed before the Supreme Court be tried, since they did not directly affect the former minister and their investigation corresponds to the National Court.
This case file brings together three different matters: the alleged tax fraud committed by Aldama and the companies used to collect the earnings from the mask contract profits, the investigated award decisions that were not examined by the Supreme Court, and the possible irregularities in the contracting of Jessica García at Ineco and Tragsatec.
The alleged tax fraud by Aldama and the mask contracts
One line of investigation affects Víctor de Aldama and the companies that he would have used to receive the benefits obtained through intermediation in the mask contracts during the pandemic.
The Prosecutor's Office and the Office of the State Attorney intend that the supposed tax fraud related to those operations be tried, which was not part of the procedure developed before the Supreme Court.
The case also includes award decisions for medical supplies that were left out of that trial for reasons of judicial competence. Among them are the contracts investigated in the Government of the Balearic Islands, whose review corresponds to the National Court.
In this way, the charges seek that the possible criminal responsibilities arising from operations that form part of the investigation into the contracting of medical supplies during the pandemic be examined, but which were not resolved in the previous procedure.
The contracting of Ábalos's former partner at Ineco and Tragsatec
Another part of the case focuses on the contracting of Jessica García in the public companies Ineco and Tragsatec, linked to the state public sector.
The facts related to those jobs have already been examined by the Supreme Court with regard to José Luis Ábalos and Koldo García. However, the possible responsibilities of other people who would have been involved in the contracting were left pending.
Among those investigated are Isabel Pardo de Vera, former president of Adif, and Joseba García, Koldo's brother. The latter would have collaborated, according to the investigation, so that Jessica García would evade certain labor controls.
The request by the prosecution seeks that the actions of those who allegedly facilitated their entry into and continued presence in the public companies be examined, apart from the responsibilities already analyzed in the Supreme Court procedure.
A new request for a trial within the Koldo case
The request by the Public Prosecutor's Office and the State Attorney's Office entails a new procedural development in an investigation that has been divided into different judicial proceedings due to the nature of the facts and the status of those under investigation.
The request by the prosecution does not imply that the opening of an oral trial has yet been ordered. It is for the competent judicial body to decide the following steps of the procedure.
The new branch keeps open possible responsibilities of former public office holders, intermediaries, and people related to Ábalos's circle for events that were not tried in the Supreme Court.
